    My son managed to contact Hmrc . The lady told him that it looked as if he should be eligible but would have to wait until the reviews begin from 18 th May.

    I am in the same boat as your son. I should be eligible, as I meet the criteria, but the online tool says I'm not. I too contacted hmrc and was told exactly the same, seems like I should be eligible, but they are beginning to look into it on the 18th so fingers crossed

    So.   HMRC contacted my son  today. .They are saying that they are treating him as employed.   He works for one of the biggest construction firms In the country  . He is paid per house with vouchers giving payment details  and has tax deducted which the firm send to HMRC.  He completes tax returns every year .  The girl has taken all his details and someone will review  and get back to him by end of May .

    Has he checked his previous returns to see how he declared the income?

    Was it on a self employment page?

    His self assessment was wrongly completed .  Another accountant has had a look at his returns and told him the“ figures were in the wrong boxes and wrong box ticked “.  Looks like it has been a very expensive mistake for my son as he has been  without any income for 10 weeks !!!

    I assume he is a subcontractor and pays tax under the CIS rules.

    He is .His employer takes 20 % and sends him his vouchers every week .

    I looked back at the earlier posts and you said he has an accountant. I do not understand how an accountant could have shown CIS income as employment income. That is a really basic mistake, and it would seem to me that it is negligent, unless there is some other factor we are unaware of.

    The accountant is his friend and deals with corporate  tax issues . My son is not blaming him as he is a really good friend and son is taking the responsibility .. .He now has an accountant that deals with CIS clients .The  new guy  is going to look through his returns and fix them out .  Probably too late for the grant .

    I think there is a difference between amending a return to reduce a capital allowance claim so as to increase profit and a grant, and amending a return to correct a manifest error that HMRC should arguably have spotted. The trouble is that the legislation does not distinguish between the two. If he has appealed and the answer is no, try explaining the situation to his MP, but the answer may be sue the accountant, which he doesn't want to do.
