nick325i said:Hi guys. sorry for the previous confusion on this. I filed a shoddy defence with BW legal and they have written back. I only just saw the letter dated 6th October giving me 21 days to respond, either payment in full, withdraw my defence or a mediation agreement.
This isnt a court letter. Should I ignore? You could show the letter - blanking out your personal details and read the newbie thread to bone up on the procedures. But going by your slow replies I'll expect a response in 7 months.“You’re only here for a short visit.

Have you really filed a Defence?
Please re-read my post of 30 March at 11:22PM and answer some of the questions therein.2 -
It was a pretty poor defence to parking charge ltd. I have been parking there for years as I coach the kids football team there. A lot of the time their computer that lets you input your number plate is down but the lady behind the counter just takes my number plate down manually and erases the record. This time she obviously didnt do it and then pandemic hit so I couldn't even contact them. I wrote to appeal the notice on this basis around 6 months ago and only just got a 5 page letter through from BW legal giving me 21 days to pay £251.040

Have you actually received a N1 claim form from CCBC in Northampton? If so, what is the date of issue? Did you submit the AoS via MCOL and if so, on what date?2

No not had that yet, only a letter from bw legal. Should I reply to them or wait for an N1 claim form?0

They have added what appears to be an extra unlawful amount for debt collection. Judges have dismissed an entire claim because of this. Read this and complain to your MP.
Excel v Wilkinson
At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims. That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued. The Judge concluded that such claims are proceedings with 'an improper collateral purpose'. This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015. DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

Show us the letter from BW unless it's the usual tedium seen on other threads (spare us that). Just tell us what the heading says.
You said you HAD filed a defence but you can't have. Did you mean appeal? That is not a poor sppeal!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
