No, the D has to put in a WITNESS STATEMENT AND EVIDENCE not a 'revised defence'.

For the love of GOD object to the paper hearing like the Order about it told you that the D could.  The D will lose this.  You will lose and are likely to lose big, including maybe costs for unreasonableness if you let the paper hearing happen.

I don't think I've ever seen a case on this forum, where the OP has so spectacularly done everything wrong that they could possibly do wrong.

It started out as a dog's dinner. Then it became a truckload of Pedigree Chum overturned and spilled all over the motorway. Now it looks like being a massive explosion at a dog food factory.

  It is not permitted to alter your defence - unless you pay a fee.  How is this happening?

Amendments to statements of case

(1) A party may amend his statement of case at any time before it has been served on any other party.

(2) If his statement of case has been served, a party may amend it only –

(a) with the written consent of all the other parties; or

(b) with the permission of the court.

One learns something new every day!  I am sure I read on this very forum (many times) that changing a defence (if that is the same as a statement of case) would invoke a fee.  I've looked at the CPR now - thanks for the heads up.

So ok sent in an objection to paper hearing , by email and asked for more time to deal with  Claim 150 page bundle.
As they have  infract made a response to part Two defense can one take that as acceptance ?

Very helpful seeing as they are attacking the 60 quid add on siting the recent appeal that was lost.
Maybe people who know better may want to help put things right instead of being sarcastic at the end of the day the out come may have future ramification's on all the win's 60 quid defense so far as its in the new claim bundle with lots of attached judgments.

Just a thought now BW are attempting to bring this forum ie these posts before the court should we not counter with lots of other posts from the many many people up and down the country who have an opinion about BW and the Cowboy parking companies as they say on TV they have opened this particular door. So the Good judge can have plenty to read. Of the opinions of many many angry people about their underhand tactics it just may back fire on them.

yes it a brilliant idea, print of every thread started in the last two years and submit that to the judge 14 days before hearing, but sure to put the case number on each page once you have printed them. Get printing!

Of course they attack the 60 add on judgment they then had overturned, but you know allthe reasons why because its been done to death. it doesnt actually help them, unless you let it help them
