I have received a CCJ on my credit score

    The facts as known to the Defendant:

    2.       It is admitted that the Defendant was the registered keeper of the vehicle in question but liability is denied. 

     

     

    3.  My car engine had been to the mechanic and had work done, I was driving through Greenwich and the ‘check engine’ light came on, a serious light, unlike the simple yellow one that has come on previously. The engine began to lose power, I pressed the accelerator and the car was not reacting. I was on a one-way street in Greenwich and I had to make a snap decision either breakdown in the main one-way street and cause chaos in Greenwich on a busy day, or pull off the one-way system safely in the first lay by and call my mechanic for advice on what to do next. I chose the latter, pulled off in the side street to which was safe, and call my mechanic, He advises let the car cool down and drive it straight to his house, where he can access the damage. At no point was I aware I had entered a street that required a parking ticket as I had just avoided a serious incident and my car had broken down and I also was focused on getting my car to him. If there were any signs saying I had to pay they were very small, not very noticeable and I am amidst an emergency

    Please advise me on where to improve and if this is a valid reason for not paying a parking ticket???

    2 should say keeper and driver

    3 should be written in the 3rd person , no My , Me , Myself & I , it's

    Will this be a valid reason to not pay the 85 fine?

    Why would you buy a ticket when your car had broken down?
    You realise that the rest of the defence is sent as well?

    Thanks again, that is the level of detail I need. Yes it chaos for me as I am not familiar with forums.
    yes copy all of it in and remove the insert on the template and signed it and a send in an email to civil enforcement.
    and the county court said they would pick it up again from there.
    I will send a copy to the courts also.

  • Hi Guys, the CCJ was lifted of my report but there was no order as to costs by the judge... so i didn't get the money back, is there an appeal for that?\

    You seem to have missed out a chunk of story!  In February you were submitting defence but had not been to a hearing.  What happened at the hearing?
  • The hearing went ahead that day and judge said if i file my defence by the morning that they would remove the CCJ, but i called civil enforcement yesterday to see when they would pay me, and the lady said that was no order to pay. is there a challenge i can make?
