only a judge can remove the CCJ , not CELI suspect from your writings above that they are offering to support your £255 set aside application if you pay them the £85 for the original pcn, thereby changing it to a with consent option, their consent is granted if you pay them the £85I also suspect this means that you wouldnt get back your £255 set aside fee , meaning it would be like you had used the £100 with consent option yet its cost you £255 instead for the same optioneven a with consent set aside needs a judge to approve it and set aside the CCJ, CEL cannot do itthats my laymans take on it1

No-one PAYS CEL when going for a set aside of a CCJ. Is that clear?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You dont pay CEL
Dont pay CEL
You win the set aside, and ask the court to either immediately order repayment or reserve to a hearing.1 -

hey guys, it seems that all of you have said the same thing, many thanks, I am relying on you guys. Can I first say they worded this email in a very funny way that seemed suspicious? would it help if I posted the email? because I have not stated a valid reason for the set-aside, they, CEL will continue to fight the case unless I paid the original amount £85.00 for the fine and it would be set aside, i need the ccj gone from my record and i am willling to do what it takes, please restore my faith a little?Redx said:only a judge can remove the CCJ , not CELI suspect from your writings above that they are offering to support your £255 set aside application if you pay them the £85 for the original pcn, thereby changing it to a with consent option, their consent is granted if you pay them the £85I also suspect this means that you wouldnt get back your £255 set aside fee , meaning it would be like you had used the £100 with consent option yet its cost you £255 instead for the same optioneven a with consent set aside needs a judge to approve it and set aside the CCJ, CEL cannot do itthats my laymans take on it

Yes, show us that email.
We haven't seen a PCN set aside application refused in about 3 years. Does that restore your faith that we know exactly what we are doing?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

DEAR/SIR MADAMWITHOUT PREJUDICE SAVE AS TO COSTS
We refer to your application to set aside Judgment which has been forwarded to us by the County Court Business Centre.
We note your grounds for setting aside Judgment, which state that you had moved address before the violation occurred. We were provided with your registered address by the DVLA following the date of violation. As you may be aware, it is an offence (punishable with a fine up to £1000) to fail to promptly notify the DVLA of a change of address.
As you do not deny being the registered keeper at the time of the violation and because you have not shown any grounds in your application that you have any reasonable prospects of defending the claim, it is our position that your application to set aside judgment will be refused. Even if the application is granted, it is our intention to proceed with the claim against you.
However, bearing in mind this process can take time and will incur unnecessary costs for both parties, we will consent to setting aside judgment (to support your application) and to discontinue the claim against you, if you agree to pay the original £60.00 parking charge plus the administration costs and fees we have incurred in trying to recover payment of the PCN, limited to £25.00, making a total of £85.00. Each party will bear its own costs of this application. Upon receiving payment, we will provide you with a draft Order confirming the above, to file with the Court in support of your application.
Payment can be made via our website; www.ce-service.co.uk, or alternatively via our automated payment line (0115 822 5020). Please be advised that if this offer is not accepted within 14 days of the date of this letter, we reserve the right to show this letter to the judge on the issue of who should pay the costs of your application.
Yours faithfully,
Legal Team

You misunderstand - I was telling you we haven't had any court refuse a set aside application!
I was telling you that we know that courts will almost certainly agree.
No-one cares what the stupid thug ex-clamper PPCs and robo-claim solicitors say...and certainly we've already said until we are blue in the face, to all such posters, that SETTING ASIDE A CCJ DOES NOT MEAN PAYING THE STUPID PARKING CHARGE!
So, because you know that, you know you will be refusing their 'kind offer'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I dont get whats hard about that letter
Theyre just saying they will consent to a set aside if you pay them £85
Why on earth would they offer that, unless they know or suspect theyre gonna lose the set aside, be made to pay £255 to you, and still have to decide if they want to proceed with a claim or not. EVen if they win the claim, they will have lost around £200 on top of the £255 on paying a solicitor.
I'm hoping you can see theyre not doing this out of the goodness of their hearts. Its a commercial decision. This way they at least get *something*.
