  • You need to tick the box that you are attaching a witness statement (the box above the info you typed into the form).

    And in your witness statement, end it with the new April 2020 Statement of Truth (Google it!).

    You haven't copied a six point draft order.  They are in every set aside thread including the ones linked in the set aside advice section of the NEWBIES thread.  You should attach an Order that you want th court to make, this is normal stuff for these cases so take an extra 24 hours over it.

    That Draft Order looks nothing like the one you would've found by using the forum's search facility.

    And I don't understand your comment about 'statement of truth'. There is no statement of truth on a draft order.

    i will put the work in to get this, i am a little rusty because everything is new, but if someone shows me i can pick it up fast, but i have zero court experience

    Your WS needs the longer Statement of Truth (Google it!), not ''I believe the facts stated within this Witness Statement to be true''.   And you can adapt the one shown by KeithP which is what we meant as your Draft Order.

    Read the examples in the NEWBIES thread, post #2 the end part about set asides.  I added two worked examples of set asides this week, including a 'completed' successful one from yesterday, where the person also got the Judge to order that his £255 be repaid by the Claimant.

    do you recommend that I use the exact same approach, just changing the claimant to civil enforcement limited?

  • Hi, civil enforcement has now sent me an email to say I could pay the original £85.00 they give me a draft order confirming the above, to file with the court in support of my application.

    please can someone advise me in layman terms, are civil enforcement completely removing the CCJ from my record? as thats what I need, or should I still fight it?
