Just a quick update to say once again thanks so much for the advice so far. The AOS was submitted as requested back in June and the Defendant has also now submitted their defence alongside the Southampton Judgement. I will endeavour to keep you all updated as to what happens next and hopefully it won't be long before I am back soon celebrating that they have won their case.

Morning all, I hope you all had a great Christmas and New Year. I want to thank you all again for your advice, support and guidance. It's been a while since there was anything to say but as promised I've come back to give you a quick update. The fine has been overturned!! The process was done via a telephone hearing and unsurprisingly HX didn't send anyone to defend. The judge was lovely, or so I'm told and she made the whole process very straightforward. She was very disparaging of HX and frustrated that she was still seeing these sort of claims but was pleased people were still fighting back even despite the extra stresses in the world at present. So thank you all once more, I truly couldn't have done it without you and am pleased to be able to be another positive outcome for this amazingly dedicated site.10

Very well done Glad that you did not take the easy option which given your circumstances at the time would have been understandable.
These judges must be frustrated as they must be inundated with family work at the moment and the PPC's are just wasting the court's time.

Another one bites the dust !!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
