There's a lot of pointed comments here. Court is technical stuff. Everyone should (nicely) be encouraged to read more - you can never read too much - and to not follow the templates too slavishly.
Some truths..
* In all cases it would be easier (if you can afford it) to pay. That is, of course, relied upon by parking cos.
* some cases will win, some will lose (inevitable risks of litigation)
* everyone must work out the merits of their own case.
* everyone is entitled to ask for advice. * No value judgement should be made for that. But if someone's not worth your time or you don't like their arguments, then go onto the next one.6 -

There are other threads where I have told the OP they are unlikely to win and to settle , usually Parking Eye threads like UHW Cardiff , a new contract , new signs and POFA compliance makes resistance difficult !!
Sometimes it's the same with Napier pay and display ones too

Can I just jump in here please? I understand much of what has been said on this subject. I feel I must add, first of all, my thanks to the team that I know try to be helpful, without this help many would be lost in jargon that most fail to understand. As a "Newbie" myself, I found the information and forum difficult to navigate. That's why I became a little agitated yesterday. Please try and be a little understanding, in my case I tried hard, too hard may be? to grasp what and where I was supposed to be looking for. I contribute to Forums myself in a similar way on totally different subjects, motor cars and motorcycles mainly, people all over the world. I always try to put myself in the "newbies" position, talk them through step by step. Now through posting on here I learnt, eventually. I am truly grateful, whether that advice is acted upon is now up to my OH, the cars RK.6

There is the assumption by the PPC's that it is just simpler to pay up than to spend time on fighting the case. They do have a point but they fail miserably to understand the mindset of many of the drivers who decide to fight their corner. It is not about the money or the time spent. It is about the principle.
PPC's will never understand what having principles means to a person as they have none. They do not realise that sending out reams of paper to a driver has no effect whatsoever.
IMHO the main issue with new posters is the lack of information that they provide. They seem reluctant to say the name of the PPC, where the transgression took place, the stage that they are at, etc. They should not however state their name and state who was driving.
PPC's all have a different MO and that is why it is so useful to know this at the outset. The regulars will know the best way to deal with the claim.

One of my biggest mistakes when fighting my case was to throw everything at it on the basis that something might stick. Part of the problem was that I had seen reports of hearings where the decisions of the judges seemed so unpredictable.
Judges that hear these cases come from different backgrounds and have focused on certain aspects of the law, family, commercial. etc. Some are not that familiar with parking law but all will be familiar with contract law. In parking cases the signage forms the contract. There is also the question of the contract between the landowner and the parking operator.
I saw a case recently that had been lost. The DDJ's day job was as a commercial lawyer in finance and property.
I don't know the background of the judge in the Tyler Christian case but I hope that they were not a family judge.
