Love holidays

Have been in contact with love holidays today to ask for a refund on my booking, they have refused and said that I will get an email, to say they are offering me a credit voucher I have looked into the terms and conditions of the booking and have found this.

In relation to Package bookings only, in addition to the cancellation rights set out above, you shall have the right to cancel your booking before the start of the Package without paying any cancellation charge in the event of unavoidable and extraordinary circumstances (which is described in paragraph 14 below) (“ Unavoidable and Extraordinary Circumstances”) occurring at the place of destination or its immediate vicinity and we have confirmed to you that they will significantly affect the performance of the Package, or they significantly affect the carriage of passengers to the destination. If you cancel in these circumstances, we shall provide you will a full refund of any payments made in relation to your booking but you will not be entitled to compensation or any of the rights set out in paragraph 13 below.

They have now added a new section to the bottom of this which was obviously not there at the time of my booking on 18th jan 2020.

I In relation to cancellations made as a result of global travel disruption arising from the Coronavirus outbreak, the initial refund of package bookings will take the form of a refund credit note, to which the insolvency protection attaching to your original booking will attach (see paragraph 22 below), which will give you the option to rebook your holiday by a certain date or (if not used by that date) to obtain a cash refund of the relevant amount.

This was not on my booking when I booked, can they change to terms and conditions, when you have already booked?

Paragraph 13 relates to this ;- 

This may cover for example warfare, other serious security problems such as terrorism, significant risks to human health such as the outbreak of a SERIOUS DISEASE AT THE TRAVEL DESTINATION  or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the destination as agreed in the booking.

ANY HELP would be appreciated we are due to travel to turkey on the 11th April

    There is an article from ABTA on the main page of my computer ( I do not know how to show it here ) where ABTA have stated that they are allowing travel firms to issue vouchers as apposed to a cash refund because the companies do not have the capital readily available to pay back , they did say that the vouchers would be covered by the ABTA scheme so you would not lose your money

    ABTA might be allowing firms to issue vouchers, however current EU regs state that a full refund should be one of the options offered
  • OP, I'm in the same situation,  due to fly to Hungary on the 5th.   I can't get through to anyone,  everything on their site says I'll get a voucher.   A voucher is no use to me, it looks like OH is about to lose his job so there's no way we'll be going on holiday within a year.
    The money is more helpful than a credit note.

    In the same boat but with a different travel provider (Voyage Prive). They have flat out refused to give us a cash refund, they've added a voucher to our account for a value less than what we paid and keep responding to our emails with the same generic email. I don't know what else any of us can do really, regardless of what we are legally entitled to, if the travel providers refuse refunds.  
  • I like how their updated FAQs regarding refunds starts with’ in accordance with guidance from ABTA...’.
    Funny how they didn’t follow guidelines or the EU law which specified cash refunds. Following guidance when it suits them.
    The credit notes are only ATOL protected until 31/07/20. Surely this will get extended as I can’t see air travel going back to normal by then. But at least those of us who want a cash refund can get one as long as we let the note reach it’s expiry date.
  • I would guess that the credit note is still protected until that date but it can be put towards a holiday later than that

    ABTA is waiting for government approval on the basis that there will be hundreds of travel business failures if everyone due to travel for Easter, around 2 million people, demand refunds. The plan is that vouchers can be cashed after 31st July if not used to book another flight or holiday, my concern is that things may not be much better by then, so where will the money be found?

    Better to have a credit note that converts to cash if unused, than have them go bust taking all of our money with them. 
    If they simply don't have the cash, then they can't refund everyone. It's that simple.

    There's no guarantee that vouchers will convert to cash. Credit notes are only protected until the end of July, and if we are being realistic I doubt they will have the cash to issue refunds by then. I stand to be corrected, if you accept a voucher and they go bust post July you lose your money (as the voucher is no longer protected by ATOL)?

    HELP!  I booked a holiday with Love holidays in January 2020 with a deposit of £228.68 for the 14-21 April 2020 flying with Ryan air to a hotel in Tenerife and paid for insurance through Love holidays which cost £1354.59 in total. I then paid £541.97 for 2nd payment in Feb and due to pay £583.94 on 31 March as a final payment.
    Ryan air have already got my full refund form and said they are working through all the claims and will get back to me in due course.
     Love holidays are yet to contact me but emailed  today to remind me the final payment is due.
     What is the best thing to do? Pay the final payment or not?  Can I still get a refund off Ryan air if i have not paid the last payment to Love holidays? I am so confused.
