Huh? Sorry that doesn't make any sense to me. I apply for a set-aside and pay £255 when the total bill is £268? Why?nosferatu1001 said:That isn't "acting" for the purpose of a set aside
get it done, with defence to underlying charge - easy; witness statement supporting set aside - easy; 6 point draft order - easy. Application form takes half hour to do, and you file for £255
or
prevaricate further with a route that's clearly not fruitful and deal with a ccj for the next 6 years
yes, it sucks that the court is being crappy but that. Doesn't. Matter.0 -
I've told you the only routes available.
pay
or
set aside
that's it. You have no other choice. Pick one
the third option, do nothing about the ccj that can actually do something , is to have a ccj on your record for 6 years.3 -
OK, so because the court made a mistake I have to either pay £255 or pay £268?nosferatu1001 said:I've told you the only routes available.

Fair enough, what a !!!!!! up country we live in.0 -
Yes. Deal with it or complain
you might be able to get the court to refund the £255 as its their error, but don't count on it.1 -
OK, and if the appeal fails I will have to pay £268 on top and if the appeal works I will get £255 refunded or probably not?nosferatu1001 said:Yes. Deal with it or complain

I am assuming the appeal form is N255?
Sorry, I just don't see where the light is at the end of the tunnel here, I am wasting so much time on this that frankly is better served running and growing my business, so if there is no light at the end of the tunnel, I will pay the £268.0 -
Do I pay the £286 then fight afterwards or surrender and pay or not pay and do something else?
That really is up to you. We have told you what the sensible thing to do is, where to find further information, and the evil nature of your adversary. No-one here would pay. without exhausting all other options.
You never know how far you can go until you go too far.1 -
You're not "appealing"
the word appeal has never ever been used
weve told you it's a set aside.Set
aside
No need to guess. The newbies thread tells you all about it
loook you can complain and we csn nod and agree it sucks. Or, you could do something about it that's actually productive. But you've been told, four times now by me alone, the only routes you have.3 -
Alright cool, I'll pay the £268.0

Now this is why you needed to stay on the phone last week, for an hour, as it's worth that much to you to get the CCBC to accept that you did return the DQ. It has to be worth a couple of hours of your time in the morning?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Unfortunately not, I'd already spent perhaps 6-12 hours since this began and far too much headspace and stress. I hate the fact that they've won the battle vs me but at the same time I am very happy it is over and now I can completely forget about it and re-focus on my business.Coupon-mad said:Now this is why you needed to stay on the phone last week, for an hour, as it's worth that much to you to get the CCBC to accept that you did return the DQ. The way I am trying to see it is that my time is worth more than £268, it might have been a few hours on the phone, but the steps I would have to have then followed and the weeks/months of ongoing communication it's just not worth it for me. I'd love to have fought it, but I need to put my priorities in order and business definitely comes before this.
I appreciate everyone's replies here and the effort that those who have put together the sticky threads have gone through and the time invested, I am sure by now this community has saved people tens of millions.0
