Fraudulent ukpc need help urgently

I need help and advice as I am clueless to where to go now or what to do these fraudsters want my money on false grounds and accusations 

I checked into a hotel in two occasions which had a system in place to register my car which I did and I got a fine of 100£ each from ukpc

I provided my booking confirmation as the hotel suggested I do I even provided a Time stamped picture taken from my phone showing me entering my registration into the systemÂ*

They refused their argument is that it's not in their system

Ok but then that means ur system is faulty

Even popla rejected my appeal

I need help as it is ridiculous I did everything required and have proof

They are making excuses on grounds of how photos can me manipulated that I have taken with my phone and bla bla

Assessor summary of your case
The appellant’s case is that they were a guest of the hotel and registered their vehicle when checking in. Please note, any further grounds of appeal that have only been included in the ‘motorist comments’ section will not be considered. POPLA cannot consider grounds of appeal that have only been raised in this section and weren’t included within their original appeal to POPLA. The appellant has provided evidence to support the appeal.

Assessor supporting rational for decision
The appellant has identified as the driver of the vehicle on the day of the parking event. As such, I am considering the appellant’s liability for the PCN, as the driver. The operator has provided photographic evidence of vehicle  entering the site at 12:16 and exiting at 14:36 totalling a stay of 2 hours and 19 minutes spent at site. When entering onto a private car park such as this one, any motorist forms a contract with the operator by remaining on the land for a reasonable period. The signage in place sets out the terms and conditions of this contract. The operator has provided photographic evidence of the signage in place in the car park, which states: “TERMS OF PARKING APPLY AT ALL TIMES … Failure to comply with the following at any time will result in a £100 Parking Charge being issued to the vehicle’s driver … 2 hours maximum stay” The appellant states they were a guest of the hotel and registered their vehicle when checking in. The appellant has provided evidence to support the appeal. However, this does not show that the appellant is exempt from the parking terms or receiving a PCN. Whilst I appreciate the appellant's comments, I am satisfied the signage at the site is clear in explaining the terms and conditions of parking at the site. Ultimately, it is the motorist’s responsibility to comply with the terms and conditions of the car park. Upon consideration of the evidence, the appellant exceeded maximum allowed stay, and therefore did not comply with the terms and conditions. As such, I conclude that the PCN has been issued correctly. Accordingly, I must refuse this appeal.

    You don't appear to have complained to the hotel.

    The car parking company are acting on the instructions of the hotel.

    Get complaining - although you may have left it a little late now that you are past the PoPLA appeal stage.
  • why is it that the quest has to jump thru hoops , is it not simpler for the hotel to ask for vrn when booking in and automate the system , I have no "apps" on my phone , dont bloody want emm , phone is for making / taking calls 

    hotel wants to set a system up , but please , do it properly

    Issue is I did complain to travelodge and they said they have no contract with ukpc and that the landlord does and that I have to appeal with ukpc the hotel stated they have no control over it since GDPR laws bla bla it's ridiculous this means if popla wishes they can just reject us and we are stuck with the fine which is done on false grounds

    Trust me my thoughts exactly thus why I took pictures soon as I entered my reg as I don't trust these systems and my point exactly look I got a fine and guess what the picture is not enough of a evidence

    These are for two fines they gave later on, on the same grounds which they reduced the fjne to £15 each after providing my booking confirmation but they are not cancelling despite these images 

    Below is the one popla rejected and ukpc
    Even if I did not have these photos my booking confirmation was sent to them to show I stayed at the hotel which means I am entitled to have free parking as the hotel stated 

    What I don't understand is I stayed there the whole stay I left 2 to 3 hours after checking in which is the fine they gave me right for staying over the limit but I came back and parked up and went into my room for hours how did they not send me another fine again for Exceeding  the limit again

    Better yet I stayed in December as the image say for 5 days and they only fined me for two out of the 5 days

    This is all just suspicious and idiotic 

    What these guys have done is built a system which does not even show you the time and date you entered your registration to confirm unlike many other parking firms

    This gives them the power to do what ever they like heck I even asked them to prove if their back end system was not tampered with such as manually deletion of my registration and nothing all they can say is we have given you this


    This proves nothing it's their system their environment and can be manipulated any way they wish

    Tell UKPC that their is an obvious error with their system, and despite POPLAs adverse ruling you will not be paying anything
    If they still wish to pursue you require them to initiate the PAP for debt claims within 14 days. After that point you will consider the matter closed. You are confident that when your time stamped photos showing the correct registration was entered is shown in court, the same photos UKPC has already had access to, you will not only win the claim but you will also be awarded your full costs. 
    In addition, as their system error hsa meant there was no need to access the Keeper database for my personal data, you are hereby notified that you consider this a breach of the DPA2018 and reserve the right to counterclaim in the event that UKPC do proceed with a court claim,  for such damages and distress as set by Vidal-Hall v Google, namely £750.

    Is it possible that a minor error was made such as entering O instead of 0 or similar as they look identical on a number plate? Even if that was the case, the scammers should not have issued a PCN.

    Complain to the BPA and the DVLA that a PCN was issued for no valid reason. This is both a DPA/GDPR breach but also a KADOE contract breach.Include your photo' evidence in your complaint. 

    Also complain to PoPLA that yet again their assessors have failed to look at the evidence provided in your appeal. Suggest they get their "sector expert" to look into this as there has recently been a spate of incorrect decisions by poorly trained assessors who could not count to 14 nor understand the strict requirements of the PoFA 2012.

    Complain to the hotel CEO.

    Leave negative feedback on the hotel website/Trapadvisor/Fakebook etcetera to warn other motorists that scammers are scamming genuine hotel guests.

    Complain to your MP about this unregulated scam. Copy in the MP where the hotel is located. Contact local press for that area as well.

    Make separate complaints for each PCN.

    Correct or not (anyone confirm?), its still a pathetic response from a business that needs happy customers (particularly in the current climate), clearly has an arrangement regarding the parking, tells you to park etc, and then passes the buck at the first opportunity.  "The landlord" is their landlord not yours.  Can they divulge if anyone else staying at the same time also had problems, might help indicate an issue with the system around that time.

    Bit of an irony, seeing how their staff were caught doctoring photos, and didn't the DVLA termporarily block them from the database a couple of years ago for misuse.  I'd take no lessons from them on photo manipulation.
