  • Should I ask in letter to BW legal that I would like all the data they have on me, pics, PCN's NTK's? and would it make any difference to tell them that I will be sending a complaint to SRA for abuse of process?

    interesting, I have drafted a letter to my MP but how would it cost them extra costs and work?

    It's PPC , see th Newbies FAQ sticky thread for acronyms , also LBC or LBCCC not nccl , or as it's a court claim , you have an MCOL N1 court claim pack

    You are asking your MP to get involved on several levels , some of which mean speaking to various government ministers about the lack of action on the new CoP 12 months after royal assent , some cabinet ministers need contacting , plus writing to the PPC

    Why restrict them to one task ? Get them moving on several fronts , some of which may not help in this case but it's about the bigger picture , nothing will change until government changes it. We have already complained to MP,s and managed to get a law passed 12 months ago in the name of Sir Greg Knight. It's not just about you or this case

    The SAR goes to the DPO at the PPC for all your data , not B w legal , but if you do write to b w legal  you can mention reporting them to the SRA , why wouldn't you ? I doubt they will care because they are under instructions from their client and have added on their own fees , even if they shouldn't

    One thing we do know , sitting on your hands won't help you , you won't know until you try , but there is an old saying

    It's the squeaky wheel that gets the oil

    But as you have a court claim to deal with , you should be working on your defence , not being sidetracked with all these distractions

    If the AOS has been done , plus a SAR emailed to the DPO at PPS (Premier Park) then the important task here is drafting your defence , the rest can wait

    Plus coupon mad has already written a defence for you to use , published on here about ten days ago

    If you have a claim, use the template defence on the thread I posted two weeks ago (search the forum).  As it is at this stage you can't ask BW to put the case 'on hold'.  No-one needs a SAR to do a template defence.

  • My claim is on the basis of Abuse of Processs. I can not recall when I got the original "invoices" from PPS or why.. We have a garage store for our business in the car park that I rent from the and owner (not Napier) and our house backs on to the car park, its a one way street without room to load / unload shopping etc so you have to park in the car park or hold up traffic, which doesnt go down well.

    Abuse of process is not a defence to the original PCN , only a complaint about additional spurious charges

    If the claimant drops the spurious charges , you are still left with the core claim

    The SAR flushes out your data which may be needed in a few months time
  • Ok thanks. I will look in to all the other areas that my claim can be defended.

    Not your drivers licence.   They got your name and address from the DVLA so confirm who you are by sending a copy of your V5 .... that's all
  • Its a different vehicle but I assume that doesnt matter?
