I have added that VCS sent me the letter in the post, they are abuse of process and added fake amount for debt collecting costs.
    A) I have looking at the second link you sent me, I cant find in what paragrahs that I need to add in my defence as the signs you need to display permit to park but no permit is needed to park on a private land.
    B) I need to add that £60 was unlawful, the £60 is unenforceable and they have no proof of loss. If you can help me to find it to add them in these defence, that would be great.
    C) In this paragraph, do I need to change it to IPC as the parking firm is a member of IPC and not on BPA?
    D) e)The claimant company fully complied with their obligations within the British Parking Association Code of Practice of which they were member at the time.
If I need to make some changes or remove it please let me know.
    A) The second link was to give you an idea of the style and format of the defence, which you seem to have managed.
    B) You have covered that
    C) Follow the comment given by 1505grandad
    D) As C)

The claimant is a member of the IPC AOS
Thanks so do I need to change from British Parking Association Code of Practice to International Parking Community?

Thanks, I have looking on the second link again but I am not sure what paragraph I need to use for my defence.
There is only 2 I have found so far:
    4. There can be no 'legitimate interest' in sending demands regarding the time taken to move students into Varley Park (university halls of residence) which reasonably will include the unloading of belongings from a vehicle over a period of days in October, then the same before the Christmas holidays. Students have residential rights which, even if there are not specific terms about parking in their rental agreements, would imply rights of way to move their possessions in and out. It seems that this Claimant knowingly sent an operative in October and in December to lurk at the site and prey on students and their families, waiting until they carried belongings inside the premises then pouncing and taking photos over a period of mere minutes, to profit from the normal conduct of moving into a home.

    10. The Claimant is put to strict proof that it has sufficient proprietary interest in the land, or that it has the necessary authorisation from the landowner to issue parking charge notices, and to pursue payment by means of litigation.

For the 4. paragraph, I need to make alot of changes as the car park is private and not for university so I need some help with making the changes.

I told you to IGNORE anything about Varley Park, as you were not there, it was to be used as an example of style and format - just DO NOT use it.  However, you do need paragraph 10 about landowner authority.
  • I have already got the paragraph 10 in my defence. Please see in paragraph 12 in post #38.
Are there anymore I need to add?

For the 4. paragraph, I need to make a lot of changes as the car park is private and not for university so I need some help with making the changes.
No you don't need our help to write that - you write that bit!
All other posters I've pointed to use that defence as a base, just re-write the first points & facts themselves.

This is so simple, you have been shown a recent defence to copy and adapt - your job only involves adapting the first few points/facts. No-one is going to write YOUR facts about the location that only you know.

You are making things more difficult for me to adapting because I have got a hard of hearing so I have got no clue what first few facts I need to adapting. If you can help me with that first few facts only a little bit, it might give me an idea what to write or adapting on these the first few facts.

Come on, please help me. I am deaf and it is not my fault!

    We are helping you.
How does being deaf affect you adapting a defence by typing in your facts about the car park (genuine question).

  • Well it does affect me because I have got some learning difficulties so i don't know what to write and I am stuck with it.
The car park can be used for to park at the back of Iceland where it is a private land so you can go at Iceland for a quick shopping.

Here is what I am thinking about to adapting a defence but here is the first line:
There can be no 'legitimate interest' in sending demands regarding the car park at the back of Iceland which is a private land.

There can be no 'legitimate interest' in sending demands regarding the car park at the back of Iceland, when the driver was a customer of that shop.   which is a private land.

How about the above?  Is it true to say the person was visiting Iceland?
You also need to add to explain if it appeared to be free parking for customers and what made you think that.
