    Council tax.  I'm sure it is the tenant's responsibility, in theory, but that would be reliant on the annex having planning permission to exist as a separate dwelling, the garden and building being put on a new title with the Land Registry, sign-off from building control, a new address being assigned and so on.  Has that happened?  Dream on, as Aerosmith once sang...  

    What the authorities don't know can't hurt them, so it's probably easier if the landlord swallows the council tax and stays schtum.

    There is no need for pp for a separate dwelling for that dwelling to have its own CT band. I'm ex VOA and have dealt with many annexes. In most annex cases the pp did not allow the annex to be sold separately from the main house, but the annex was still correctly given its own CT band. In fact annexes no longer have to be completely self contained to be given their own band. Unusually there are 2 separate pieces of CT legislation  which allow an annex to have its own CT band

    An annexe can have a separate council tax banding, but that relies on the structure meeting the definition of an 'annexe'.  The listing being discussed is a separate building with independent access and facilities, offered to let on the open market on an AST.  There is no suggestion that it will be occupied by a family member of the householder of the main property, nor that the tenant will have any access to the house proper.  As such it is functioning as a separate dwelling and, as you say, ought to be paying council tax as a separate dwelling.  The fact that it isn't indicates the authority haven't been appraised of what is actually going on there.  To my mind it fails to fulfil various criteria applicable to an annexe or granny flat.   
    The fact it would be let on an AST to a non family member, reinforces the fact that it should be separately banded. From memory there is no legal definition of the term "annex". Although at one time to qualify as a separate dwelling (dwelling is the term used in CT legislation) for CT purposes an annex had to be fully self contained, that is no longer the case. There was a thread on (I think) the CT boards where a house was divided into 4 or 5 bedsits each with its own en suite, but sharing the kitchen, each bedsit correctly had its own CT band. 


    It is possible that pp has not been applied for, or if it has, then the banding process is taking time to work through the system

    The other option, of course, is for the landlord to declare the tenant as a 'lodger', again dubious but people do it.  A lodger wouldn't pay council tax.  
    It is not "dubious", it is CT fraud

    I suspect most of these "beds in sheds" don't have planning permission.  Some of them will have a certificate of lawful development, which just means they got away with it un noticed for long enough that the the breach of planning rules could no longer be enforced.

    I always understood an annex is where the occupier shares some facilities with the main house, e.g they may use the main house kitchen.  A wholey self contained unit that has it's own kitchen and bathroom and does not need to use anything in the main house, is not an annex, so as already mentioned should pay it's own council tax.

    How that sits with a council who don't want these sheds in beds but can't enforce their removal because they got away with it long enough is an interesting matter.  If they accept it and give the shed it's own CT entry then they open the door to a subsequent planning application for a proper house on the site.  So they possible just ignore the CT they could be collecting to prevent that?
