It's been relisted with another agent. I wonder if the first one dropped it out of shame?! The new agents have conveniently forgotten to add pictures of the outside that shows it's a shed. It's really no wonder sometimes that landlords and letting/estate agents get a bad name. (I know they're not all bad! But these ones are!)lincroft1710 said:1 -

Council tax. I'm sure it is the tenant's responsibility, in theory, but that would be reliant on the annex having planning permission to exist as a separate dwelling, the garden and building being put on a new title with the Land Registry, sign-off from building control, a new address being assigned and so on. There is no need for pp for a separate dwelling for that dwelling to have its own CT band. I'm ex VOA and have dealt with many annexes. In most annex cases the pp did not allow the annex to be sold separately from the main house, but the annex was still correctly given its own CT band. In fact annexes no longer have to be completely self contained to be given their own band. Unusually there are 2 separate pieces of CT legislation which allow an annex to have its own CT band

An annexe can have a separate council tax banding, but that relies on the structure meeting the definition of an 'annexe'. The listing being discussed is a separate building with independent access and facilities, offered to let on the open market on an AST. There is no suggestion that it will be occupied by a family member of the householder of the main property, nor that the tenant will have any access to the house proper. As such it is functioning as a separate dwelling and, as you say, ought to be paying council tax as a separate dwelling. The fact that it isn't indicates the authority haven't been appraised of what is actually going on there. To my mind it fails to fulfil various criteria applicable to an annexe or granny flat.lincroft1710 said:

The other option, of course, is for the landlord to declare the tenant as a 'lodger', again dubious but people do it. A lodger wouldn't pay council tax.0
