    Hi All,
    Hope you've all had a Good Xmas! 

    Back to reality after a lovely break...I've now received the SAR request from Link with all the evidence they hold on me and confirmation from BW Legal that they will put the case on hold for 30 days before they pursue the fine again.

    As this hasn't resulted in the tickets being cancelled, do I now go back to ignoring the intimidating letters from BW again? My understanding is this- I have to date received only the LBC from BW, so do I now wait till I get an actual Court Claim from BW? Would the recommendation be to start preparing documents for the court case now or wait until I receive a Court Claim?

  • Have you read through the sar details, so you can look fir any errors they may have made? Have you, as above, got all your docs together?

    Keith - Okay, so I will ignore any further letters from BW until I receive a County Court Claim form. From your experience, and out of curiosity, when they issue a Court Claim, how long is it typically from the date they issue it to the date you are expected to go to court?

    Fruitcake - I have all the documentation to support my claim from the first time I appealed (which was a mistake!) but I have the documents nonetheless. With regards to the complaints, they have all just washed their hands and said that they do not deal with any of this and to contact Link directly...so it was like talking to a wall.

    Nosferatu - I have looked through everything, it is just a bunch of photographs of the car along with the signage- the same 'evidence' from the first time around.

    I am surprised that you expected the PCN,s to be cancelled , this rarely happens , the court claim is more likely in early 2021

    A typical court case from start to conclusion is maybe 6 to 12 months , so may be over with before Xmas 2021

    Read plenty of court claim threads to learn that and other tips.  It's FAR better than staying on this tiny thread asking questions.

    Hijacking my own thread for an update and a query on another ticket! (very similar situation but hoping to go on the offensive this time).

    Original thread update - this is still on going, we haven't heard back from Link Parking's solicitors, BW Legal, since I asked them to put the case on hold for the 30 days, fingers crossed they've dropped it as its been almost 3 months!


    I have a query on another ticket that I have received please, its a bit of a tricky situation...I am of course not going to pay or respond but I am wondering if I have enough evidence to somehow turn it on them and take the attack to them?

    So we finally moved out of the flat yesterday (there I was thinking I don't have to deal with Link again, how wrong I was) and my girlfriend came over to help me move the final bits from the flat. She was parked in the 'visitor' space for no more than 15 mins and she received a ticket. (Not sure why they call it a visitor spot because no one is allowed in unless they have a permit! so it's a bit of a misnomer).

    Anyway the ticket guy gave my girlfriend a ticket but not to another car parked in a spot, the EXACT same spot in which we have previously received a ticket. In fact, since my original ticket, I have seen numerous cars parked in that spot and 90% of the time they do not get a ticket- I've thought maybe they've all got lucky every time, but this time I know the ticket guy was there when this car was parked and better yet, I have photographic evidence of that car parked when he was there. 

    I took a photo of the other car parked at 17:34 (with no ticket), my girlfriend parked her car up at 18:30 and got her ticket at 18:40, and I took a photo of other the car still parked there at 18:54 (still with no ticket). It infuriates me that we have had a ticket for parking there unknowingly but everyone else keeps getting away with it. And on the day of moving out, we get a ticket for parking up for just 15 mins!

    Is there any chance that I have enough evidence to take the attack to them?

    Original case - keep hold until 6 years are up. Don't expect them to just give up, as you know from reading other threads, 

    No, not really.  It's a civil claim. For all you know they do have a permit. 


    So why won't you respond? That's NOTnwhat the newbies thread instructs!

    They do not have a permit as its meant to be clearly displayed, the parking spot in question is right next to my flat so I have clear visibility and they did not have a permit. So it seems to be double standards.

    Pretty sure the newbie thread states to ignore any threatening letters and to not appeal the ticket. We are nowhere near CCJs for this secondary ticket.
