Universal Credit mistake and not paid Urgent help

Hi,
I need urgent help.
I made a new claim and applied for UC in 23 december 2019 (after my job ended). I went into the UCwork meeting and they said UC was approved. I attened the UCwork meeting where they said I would get the money to pay my landlord by 20th/25th January and because the money is not enough I would have to look for the rest else where as my rent is more than what they pay.

Today I recieved a message from UC stating that "Earnings reported by your employer" it is over what I am entitled to on UC and therefore my UC amount is basically a negative amount and I will recieve £0 for this assessment period.

I am in shock now and breaking down beacuse my rent is due tomorrow and I don't have any money to pay it and I have run out of money for food and utilities because of this.

I can only assume that they are using the salary I got paid before I made my new claim, they are using this as earnings and I was unemployed when I made the application and have no job or money.

How can they correct this? Will I still get paid?

When was your last salary paid from your previous employer?

If your salary was paid after the 23rd they take it into consideration. This is why when I finished my job on the 20th December I didn't claim until after I got paid at the end of December! I claimed about a week after my last payment!

It's a ridiculous system they have in place! That and the benefit cap. My UC covers my rent plus about £50 per month, the housing benefit portion is short of about £300 of my rent and it's not even an expensive place!

Reapply immediately, don't delay, and apply online for an advance, if you can. It will need to be repaid over the next 12 months, but you could have it within 3 days.
  • You might be able to look on your Personal Tax Account on gov.uk and see what information this employer has reported.

My salary was paid on 20th December to my bank account and payslip. I really need the money urgently. I phoned up and they said they will book me in to JC to discuss this issue next week and they just read out whats in my UC \website area.

Can I do a new claim and get the money I'm owed so I can pay rent, food , transport .
  • You have an active claim. Did you get an advance already?

It doesn't work like that because you already have a claim, which hasn't closed.

As you only claimed on 23rd December, you wouldn't receive any money anyway until 5 weeks later, which would have been next week and not in time to pay your rent by the 25th January.

Have you received any other wages during your assessment period?

As far as DWP are concerned you aren't owed anything.

A new claim would potentially result in a new amount being payable but that isn't going to change anything with regard to what you feel you are owed in relation to your existing claim.

No (I guess i made a mistake) I did not get an advance on the UC appointment because they said they were going to pay me on 25th/29th latest and I believed them. This small delay would haven been acceptable to my landloard and now they have decided to take my last months earnings as income for deductions, paying me £0 and I had no job since the claim (1 month) and have rent, bills etc to pay because they literally lied about the payment and have conned me. How can I be expected to look for work in this state with no money and landlord eventually asking for his money, my contract is on periodic and if he finds out, he could decide to find someone else They have my rent contract and should know this (I've lived in the borough for 12 years and cannot get a flat hence have to rent privately)..The awarded money is also £400 short of my rent payment meaning I was going to use the full UC payment on rent alone (this is inhumane).

If you can prove that you were paid the earnings before the UC claim was started and received no earnings during the UC claim period, then once the evidence has been provided, this can be resolved quite quickly. The Job Centre can raise an RTI earnings dispute with your evidence and if accepted, the Service Centre will arrange to remove the earnings declared late by the employers, which will then enable you to be paid.
