Also, looking online it's unclear if I can get a CCJ set aside / cleared if I do just make the payment and then go through the whole legal process, but surely this is doable? I would honestly rather pursue that option than play hide and seek with a bunch of thugs.

once you have made payment , thats it ccj stays there , no setasude coz you paid up , await help from bailiffs online

No, it's not doable by paying the sum. If that was an option we'd have told you, honestly.

That just marks it 'satisfied'. Useless to you if you want credit, loans, or even a new phone contract or store account in the next six years.

Please listen to what we are telling you. Google satisfied CCJ and you find things like:

    Please don't try that.

Not least because the huge sum Newlyn want, is FALSE and would not be granted by any Judge when faced with a well informed Defendant from this forum, armed with our advice and wording.

You'll pay nothing, and the odd 1% who lose at the actual final hearing re the PCN, pay under £200 with no effect on their credit. 99% win and claim their costs. Someone last week got over £500 in costs awarded to them, and sassii got a 4 figure sum a year or two ago:

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok sounds good, the main thing now is just to hold off the thugs while all this is resolved. I've emailed the bailiffs, I won't phone them, but I'm assuming I can still phone the solicitors (Gladstones) who instructed them, right? I'm hoping they can instruct bailiffs to hold fire for a while.

Do not ring anybody. A phone call is worth the paper it's written on. If you want to communicate do it by email.

As long as any car you own is not parked on the drive, so away from hose or in a locked garage you have nothing to worry about from the lot
  • Quick update, spoke with solicitors and they've received my SAR and told me they're holding bailiffs off for 30 days. Fingers crossed that will keep them away until I have the evidence.

Erm, have you not filed your N244 application yet?

    You CANNOT WAIT 30 DAYS.

You have a very limited time since being made aware of the CCJ - under 3 weeks for sure - to make your application to the court.
You CANNOT wait for a SAR response as if they take 30 days, youre screwed.

C-M - im shocked you didn t pick up on that!

Also, Gladstones could have just gone yeah, we'll hold off (on a phone call) then told the bailiffs - get round now, theyre going to get a set aside.

Take the above advise, get the application done this weekend and logged with the court early next week

No, from what I've read I could not do that until I have all the necessary evidence because I will need to attach it to the form. But I guess that wrong so I will go ahead and fill in the N244 today. Thanks for the heads up.
  • Interesting update: spoke to the county court, they said this case was never enforced, and they're not sure why it went to the solicitors. They couldn't give me details beyond that.

Regardless of that they've told me to just submit the N244 and ask for the fee to be reimbursed by UCPM after the hearing so I've done this.
