Correct, you’ll get nothing but will still have to pay whatever percentage you agreed to the claims company out of your own pocket, so if the claim is tens of thousands then you could easily be talking about a ten thousand pound bill that you are liable for.

Will you be able to cover this?

Using the OP’s earlier guesstimate of a £50k payout, they’re looking at a £12k CMC bill, provided it was signed after the implementation of the 20% (+VAT) fee cap.

If you have that lying about, then fair play, if not, I’d brace yourself.

A Barclays PPI complaint handler shouldn’t be giving anything remotely close to financial advice either - they have no idea of the state of your bankruptcy and how any potential payouts may affect this.

Jonathan Kelvin, I havent agreed to anything because I thought I wasent eligible to claim anything. The Barclays person assured me I got nothing to lose. What else can I say?

Well then how have allay got involved? They don’t just magic up your details and your signature, you have provided them to them at some point.

Get your head out of the sand, this has the potential to be a very expensive problem for you, stop quoting the Barclays woman.

I have found the banks do not understand the B.R process, many posters on this board have been given the wrong information from their bank.
When you went B.R you gave up your right to claim ppi this went to the O.R and you would have signed paperwork to this affect.
It really is a line in the sand.

Right let me put everyones minds at rest especially mine.

I have literally just got off the phone to Alley claims department, took me half hour to get through but I was determined for an answer.
Alley has explained to me they work on a no win no fee basis, and take 10% of any successful claims, so regardless of what happens I won't be landed with any bills from them.
Plus they said in some cases the OR has their percentage and I will get mine, but couldn't say what that is at this stage as I got 26 different cases, not all Barclays.

It will still be a successful complaint if the money goes to the OR.

Up to you if you want to use a company that charge a fee - you can do this for free yourself, but the deadline for PPI claims has past. If you do your own research you will find that once your made bankrupt then you wont be able to claim PPI, which is an asset of the OR so not sure what "your percentage" would be.

This is written all over the citizens advice web site, and gov.uk site and many insolvency sites.

There has been folk in the past that have been successful in claiming thousands in PPI refunds which have all gone to the OR and then the poor sap receives an invoice for the fees from the company.

    You have been warned.

You appear to have selective hearing. A 'win' for Allay is getting a refund, it doesn't matter at all who gets the money (OR or you) YOU will have to pay them their cut.

zx81, if it all goes to the OR then so be it. I'm just stating what Alley have just confirmed I won't get hammered with fees as its all done on a no win no fee basis. But they went onto say I still might get something if the PPI is greater than what I went bankrupt for. The Barclays PPI woman said a simular thing. So I just got to hope the PPI return is more than 38 grand. If not I wont get a penny, end of story.
