Until the government change the system , it will be and is exploited , hence why we tell everyone to complain about the issues to their MP
The new CoP is with the BSI and will receive public consultation very soon , the Mhclg have overall responsibility5 -
I would be interested in perhaps trying to do what Redx suggested and claiming for Obtaining your data without just cause is probably easier , with say £300 to £500 as a claim figure...where would I find the information to do this and has anyone else been successful in claiming for this?0

I did complain to the MP who passed it on.I posted the reply on here the other day.......at least I attempted to do so with my broken computer! I also complained to the Welsh Assembly who own the land in SA1...I also posted their reply on here which gave figures of how many appeals were successful...not many from memory I think it was 4!2

Janetx said:how can they continue to get away with it..........how is it that judges do not realise that they have no legal right to claim because they are not the Landowner, and also accept and refer to their alleged agreement as......... a contract..............I was also under the impression that Solicitors are officers of the court and are not supposed to, knowingly, act improperly.... therefore how come these legal firms can continue to act for these Parking companies................
People that are frightened to go to court should not be because if they have put the work in, will be able to stand up to these legals because they have much more knowledge of the case.

The answer I gave is one part of how it could be done , despite the fact that you have already done some of it
You will also find that Mr deep tells everyone this in his stock replies ( D p dance )
He advocates complaining to the SRA regarding their conduct
MCOL has advice on bringing a claim against the parking company and landowner
You asked how and why there need to be changes , I answered the exact query without reading pages and pages of background
People like coupon mad regularly tell winning defendants to bring a claim , as does Umkomaas , D p dance , plus a few other regular contributors here who I cannot recall , so read other threads
There is one person on here that claims to have raised dozens or hundreds of claims and claims a very high success rate , find their posts and read them6 -
There are a couple of claims/counterclaims in the offing relating to compensation for distress and abuse of DPA data. Not concluded yet so may or may not prove useful examples. There is already Clay v CEL that I've posted about and shown the transcript for before, where Simon Clay got £200 for data abuse alone (no aggravating features, no harassment or discrimination in his case hence £200 was awarded only).
If you decide to claim for compensation for distress, harassment etc then it is a high bar to reach and wouold need careful planning and wording - not yet though. There is no rush, stick around and as planned, comment from your heart to the public consultation.
WELL DONE!

I wrote again to my MP...I was am so upset that they keep getting away with robbery......below is his reply...I am concerned that I may have done something wrong in quoting this forum directly to the MP ? I do hope it was okay to do this?Geraint Davies Geraint.davies.mp@parliament.ukHideDear Geriant Davies,This went to court. My daughter is disabled and was persecuted by this company Excel Parking Ltd for over a year. It caused immense stress to her and her family and exacerbated her condition.Someone needs to do something about these private parking companies and I am asking you to fully investigate the deplorable practices that these companies are getting away with. This is a massive scam! They are not the Landowners and they do not have any legal right to take people/motorists to the small claims court or to issue these Parking Charge Notices which are not fines but invoices! Most Judges are oblivious to the fact that they have no legal right at all to issues claims. Please read the trust pilots web site https://uk.trustpilot.com/review/www.excelparkingservices.co.uk this highlights just a small amount of posts by individuals who have been ripped off by Excel Parking and their sister company is Vehicle Control Services LTD.Most people pay up..... anything from £70.00 to £155.00...to £180.00 or more, because they are too afraid of court proceedings and don't know how to defend themselves in court. Some of the claims are years and years old up to six years and in some instances the individual has even sold the vehicle on, some claims are multiple claims which amount to huge sums of money which cause terrible hardship. Some are taken to court or issued with PCN's by these companies and they have residents permits but as so afraid they pay! Please also refer to the Money Supermarkets web site forum and the threads and advice for people to attempt to defend themselveshttps://forums.moneysavingexpert.com/discussion/6157647/excel-parking-services-have-taken-me-to-the-small-claims-court/p4Once you investigate, you will come to realise with horror, the sheer scale of theses operated scam by Private Parking Companies who have no legal right issuing Parking Charge Notices or issuing claims in the Small Claims Courts throughout the country.Simon Renshaw Smith owns both companies, Excel Parking and Vehicle Services Control. His annual turnover for Excel last year was 15.4 million. 92% of his profit is made from issue of the Parking Charge Notices, which he pays no VAT on.I look forward to hearing from youThank you

He'll probably get just one reply. If he does get two, then he'll have two fob-offs!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
