The thing about suing is that there are two stages. The first is going to court and winning your case. The second is collecting the money, assuming that you win in court. If this is a tiny limited company, it’s usually easy for the builder to close that one, with nothing in it, and start a replacement. The result is that you never get paid.Thank you.
So his ex company ends up with a CCJ and he gets await scott free?
The consumer wins again...
I said this several days ago:-
Then you sue the old builder for the net cost of the rectification work, over and above what you owe him.
The old builder will defend the claim. You'll need to get an expert witness to counter what the builder says. Eventually, you may win your case. Possibly.
Then, you need to start trying to collect your money from the old builder. Is it a limited company? If so, he'll close down Jolly Good Builders Ltd and start up Jolly Good Builders (Been Established 20 Years) Limited, and you can go whistle. No reliance should be placed on the above! Absolutely none, do you hear?0 -

It really ain't that simple, despite what you may read on t'internet, especially if the company owes money.0 -
