Yes of course you can. I have to say that 7 days seems awfully short, it is normally 14 days. What does the order actually say? You didn't have a previous order that has been superseded by a video or telephone hearing? You don't need to assume anything as the whole court process is laid out for you in the NEWBIE sticky including a link entitled "know what you must do and by when."memphis73 said:Hello, thanks for all help to date - I now have a court date, the 11th December, and need to file what I assume needs to be witness statements 7 days before. Should/may I post these here for thoughts?

Read above
courts are often now sending out two orders, both are in play. One sets out the initial document exchange, USUALLY 14 days, and another to do with the remote hearing, from 3 days to 7 days. Both need to be complied with unless the second explicitly overrides the former. You know you need a WS and exhibits. Newbies thread!!!5 -
SEVEN DAYS BEFORE? No, not later than 14 days before, surely - i.e. this week...look at the FIRST Order.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hmm, what to do? This is the only order I have had. The previous coreespondende in March simply said that my case had been allocated to the court in question. This letter says “no later than 7 days befor the hearing the parties must send to each other and the court copies of all documents upon which they want to rely” and ditto with the phone number.0

This is incredibly helpful. And a little daunting. Best crack in with the statement, and see how we go. Should I post it here or privately? Heading to the newbies thread againRalph-y said:This may well be of interest to you ...

OK, I am guessing they arranged this hearing at short notice and are trying to get through their backlog. So it IS seven days before the hearing, at the latest. I apologise for posting that it must be 14 days; we thought you'd be late filing and serving your WS and evidence then. But you are not.memphis73 said:Hmm, what to do? The WS is to be based on the example in the NEWBIES thread. There is only one example WS link and a list of typical evidence.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Essentially COVID has mucked things up. "Usually" for telephone hearings there has already been a hearing set and converted. Hence the double check !3

Hi all, I've attached a PDF of the WS as it stands. Would welcome any thoughts or advice at this point. I feel I may be missing a defence with regards this being railway property? Direct Messages or comments here gratefully received. -Thankyou!0
