    As above. We have seen at least one case where the bundle sent to the court contained a different site plan to the one that the defendant had supplied to the scammers.

  • Can I not send them my bundle in that case? How do we go about loading these forms and agreeing ?

    Erm, obviously you do what it tells you to do. Liaise with the claimant. That means you make ONE attempt to contact them.  If you get no luck in the matter then you send to the court YOUR bundle, explaining the claimant did not cooperate. 

    6) is really clear.

    You must contact the claimant and AGREE a joint bundle.  You have already sent to the claimant your witness statement and evidence - they will have a copy of your defence straight from CCBC - so I suggest you create an index, perhaps using one of the forms the court sent you, and list all your pages stating, for example Witness Statement page 1; Witness Statement page 2 ................ Evidence Ref NNN_0001; Evidence Ref NNN_0002 and state that you expect the claimant to file those with the court by the agreed date

    They should already have your bundle, they are responsible for sending a joint bundle to court, you must contact them (by e-mail preferably) and agree what they are submitting.

    I really wish you all the best with this. I hope that the judge gives the Claimant a shot across the bows and awards you unreasonable behaviour costs. This has impacted on your health, the enjoyment of your property, your employment and your time.

    By the way did you counterclaim?

  • Thank you..You are spot on. Its have really affected my health and definitely the enjoyment of my property. My neighbours  continue to park within their lines with their buggies and car seats so I have to park more out of the lines to avoid them damaging my vehicle. The matter also still remains lingering at work due to this case being open. I had hoped they wouldn't pay the trial fee but looks like they went ahead. I did call the courts to check but the queue was too long. I didnt counter claim.  Of recent my health has taken a turn for the worse and I have a potential cancer diagnosis hanging over me. I am awaiting the result after an mri. This is just an extra headache I dont need.
