  • So after a 3rd attempt to get CCTV they finally sent it via a file sharing site on 3 different parts unprotected. It was recorded onto a personal device for some reason with multiple voices in the background sounding Eastern European. One to make you chuckle 'Jump Around' was playing in the background! :j Not happy with how the data has been handled tbh and certain it's a gdpr breach. They never requested Identification in the initial SAR.

    If they have made personal data publicly available, then yes thats a GDPR breach and instant ICO complaint.
  • Signage that they are relying on wasn't there in December when I got my 'invoice'. The yellow sign saying authorised parking only is a recent addition, certainly wasn't there when I parked and isn't on their photographic evidence. It's another company trying to extort money out of drivers

    Hi manpreet.  Please start your own thread, otherwise things will get confusing for the OP.
  • Members are right, the IAS are an waste of time.Not fit for purpose. My appeal was rejected.

    The Appellant should understand that the Adjudicator is not in a position to give legal advice to either of the parties but they are entitled to seek their own independent legal advice. The Adjudicator's role is to consider whether or not the parking charge has a basis in law and was properly issued in the circumstances of each individual case. In all Appeals the Adjudicator is bound by the relevant law applicable at the time and is only able to consider legal challenges and not factual mistakes nor extenuating or mitigating circumstances. Throughout this appeal the Operator has had the opportunity consider all points raised and could have conceded the appeal at any stage. The Adjudicator who deals with this Appeal is legally qualified and each case is dealt with according to their understanding of the law as it applies and the legal principles involved. A decision by an Adjudicator is not legally binding on an Appellant who is entitled to seek their own legal advice if they so wish.

    I am satisfied that the Appellant was parked in an area where the Operator has authority to issue Parking Charge Notices and to take the necessary steps to enforce them.

    A number of images, including a site map have been provided to me by the Operator which shows the signage displayed on this site. After viewing those images I am satisfied that the signage is sufficient to have brought to the attention of the Appellant the terms and conditions that apply to parking on this site. I can see from the images provided that there are a number of signs located around this site, including entrance signage and in my view these are clear and visible. There is no requirement for signs to readable from a vehicle. It is the driver's responsibility to read the signage, including exiting the vehicle to do so if necessary. The fact that the signs may have changed since the date of the parking incident is not a relevant consideration - I can only take into account the signage as it was on the date of the parking incident. In addition to the signage around the site, the bay in which the Appellant was parked and the bays next to it are clearly marked with the letters ADC was in some way related to the business of which he was a customer. I do not accept the Appellant's contention that the signage was insufficient.

    The terms and conditions of parking at this location are such that drivers must be pre-authorised to park in allocated bays. It is the driver's responsibility to ensure that they conform with the terms and conditions of the Operator's signage displayed at this site. By parking in an ADC bay, which was clearly marked the Appellant breached the displayed terms and conditions and as such I am satisfied that the PCN was correctly issued on this occasion.

    I have considered all the issues raised by both parties in this Appeal and I am satisfied that the Operator has established that the Parking Charge Notice was properly issued in accordance with the law and therefore this Appeal is dismissed.

    My conclusion is:

    In other words you most bring  ladder and walk to the nearest sign and read the 5mm lettering on the then signs  in November to understand terms and condition.

    As the wording is it is the law,I will write to my MP, as this law is an !!!!!!.

  • Hello I have appealed via letter in which Parallel Parking Ltd said was okay, I sent it recorded delivery I have now received a letter from Gladstone's Solicitors requesting I pay. I have contacted Gladstone and Parrallel Parking Ltd and they say no letter was received yet I have evidence I sent it recorded delivery. I am now on anti depressants because of this all :( someone help me please
