Parallel Parking LTD Fine

Hello all, I received a parking from Parallel Parking LTD last week for supposedly ‘unauthored parking’ outside Eurocarparts in Coventry. The alleged offence was in early November. The store is in an industrial estate with parking spaces. The car was parked opposite (well opposite the Company Van! So close as can be)
I was not the driver.
I appealed as the keeper. I can show what I appealed to them in another message if you need, but did not reveal the identity of the driver.
The appeal got rejected (of course). They are IAS approved and haven’t even used POFA in the original PCN. This is the rejection below. They seem to have dismissed POFA and are threatening to present CCTV to court if I don’t pay… I have seen the screenshots they sent me and just shows timestamps of the vehicle and pixelated image of the drivers body head exiting the car door. No face shown. Concerned if they try and accuse me..
Their grammar is poor too. This is copied from the appeal rejection.

Thank you for your patience whilst our appeals team have been busy reviewing the evidence and the comments that you have made.

On the day in question you failed to adhere to the terms and conditions displayed around the site.
From all the evidence gathered, i can confirm that the PCN was correctly issued, therefore we unable to cancel the Parking Charge Notice.

We are acting on behalf of our client, whom state that if a vehicle is breaching the terms and conditions of the site, a parking contravention is being committed.

I am sure you can appreciate our team have to treat all customers who breach the terms and conditions of our sites fairly and consistently and, as such, we have PCN’s issued in order to ensure customers adhere to them.

Whilst we are in no way implying that you have deliberately and willingly breached our terms and conditions, there are those who use our facilities that do, and ensuring we have a consistent approach is crucial to the management of our sites. You are also responsible for ensuring you park adhere to the terms and conditions.

We are instructed by the land owner to manage this land. This isprivate landfor authorised
vehicles only. Signage is clearly displayed at the entrance and around the site. If you did not agree with the terms and conditions that leave you liable, you should not of entered the land.

Our customer service agent's clarification;
All are images are time and date stamped. I have attached a closer image of your registration. The vehicle i parked in ACD spaces, not euro
car parts. Signage is clearly displayed on the buildings warning drivers. Only authorised vehicles car park in ADC spaces.
We have now extended the discounted payment period until 26/12/2019 to allow you time to pay. Please now make payment of £60.
We must advise you that once the discounted payment period passes it will not be offered again.
We have now reached the end of our internal appeals procedure, this decision is final there will be no further correspondence regarding this
appeal.
You now have the following options;
1. Pay the parking charge of £60 by 26/12/2019 , You can pay by credit/debit card by calling 03330230115 or online at https://parallel.ec
6pay.com/ alternatively send payment to the address above with your PCN number and registration number.

2. If you believe this decision is incorrect, you are entitled to appeal to the independent appeals service (IAS). In order to appeal, you will need your parking charge number, your vehicle registration and the date the charge was originally issued. Appeals must be submitted to the IAS within 21 days of the date of this letter. Please be advised if you choose to appeal to the independent appeals service and your appeal is unsuccessful then you will lose the right to pay at the reduced rate. 3) If you choose to do nothing, we will seek to recover the monies owed to us by proceeding with court action against you where video footage
will be provided to the courts of your stay on the site.

Any advice is greatly appreciated! They seem to be playing hardball threatening court. Think the company has only been registered since May 2019…

    It is not a fine, it is an invoice from an ex-clamper to compensate them for the alleged harm they suffered when you did what you did. We call it a scam. Pay them not a penny unless a judge so orders it.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    No valid appeal is possible after an IAS member rejects the initial appeal

    All of these private parking companies threaten court , it's crucial to the sc@m

    Ignore the letters , but keep everything , come back if they issue a formal LoC , or an MCOL court claim via the CCBC in Northampton , within 6 years

    No , but you can make them reveal it to a court , or they suffer the consequences of failure

    If they say they have CCTV footage which incorporates your vehicle's VRM, I'd chance a SAR to see if they do release it to you. I'd keep pressing them even if they refuse. Because if they don't have it, they'll be very edgy about how this may play out for them.

    They are very definitely new kids on the block, in fact they've had their snout in the trough for under 3 months. They'll not be experienced enough (imho) to handle an assertive and determined challenge.

    I can't see them confident enough at this stage to chance a court claim - but they do have 6 years to try.

    If you don't ask , you don't get , but if they fail to produce it for a SAR , they would struggle if challenged in court, chances are they are thickos chancing their arm

  • Thanks for the advice guys, I put the SAR of particular interest for the Cctv involving the VRM. Haven't received an email back but definitely emailed the address on their privacy page. They have until mid Jan to respond so can assume they will send me more rubbish in the post?

    Had a look on pepipoo forums and have seen some threads pop up. The advice is no way near as good as here! ��


    I will take this to Court if required. Completely dismissed pofa in my appeal lol.
