6.1. The amount demanded is excessive and unconscionable and especially so when compared to the level of Penalty Charge Notice issued by the local Council which is set at £50 or £25 if paid within 14 days.

.............when you are talking about £40 in your point 6. You need to lay it out for the judge that you are talking about £50 versus the amount claimed in the POC.

The Caernarfon case number FTQZ4W28 - case number should be amended to F2QZ4W28 as per Coupon-mad's amended post on beamerguy's thread

Thank you for your comments. I will edit my last version of the defence as soon as possible. I will lose access to scanner after today and would need this to print sign and then email to courts before 31st deadline.

I have received copies of the PCN's. How can I tell if they are compliant? They say that as the driver has not paid and that they do not know his name or address and as the registered keeper, I am now invited to pay the unpaid charge, or if i were not the driver of the vehicle, to notify us of the drivers name and a valid current UK address (using the form). Then it says that after 29 days they have the right to recover any unpaid part of the charges from me. Protection of Freedom.

Also, on the claim form, there is a column stating the final costs. They include Legal Representatives Costs of £70-00 plus a court cost of £60. Is the £70-00 another claimant cost and is this allowable. They have already added £60 to each of the four tickets

The abuse of process post #14 and the Crystaltips76 judgment by DDJ Joseph indicate the additional charges are not recoverable due to the Beavis judgment in the Supreme court
