Have you read beamerguy's Abuse of Process thread in which Coupon-mad (in the thread's post 14) details exactly what you need to be arguing in your (Supplementary) Witness Statement, which comes a bit later in the process.

You could, in its entirety, but more in keeping with the layout of the rest of your defence, you could just highlight the key issues - PoFA, CRA and the Soton, IoW, Caernarfon and Warwick court cases - then add the more detailed stuff in a supplementary to your Witness Statement much later on in the process (which, to me, seems a much neater way of doing this).

It's been upheld by the Judges in the cases referenced. Have you read them? Make your own mind up after doing so.

I have read the abuse of Process by Coupn Mad. Wow! how are normal people going to know this and be comfortable presenting their case?

Needs must, because it's unlikely anyone is going to come along like a knight in white armour, I'm afraid. But it's unlikely you're going to have to speak to it like a modern day Rumpole of the Bailey. Enough hopefully just to bring it to the Judge's attention. He/she is required by law to consider the CRA aspects.

Thank you all for your continued help with this claim.
I have contacted One Parking for copies of documents (SAR) but I am missing the letters from the people they appointed (ZZPP etc) Have now emailed them.

With regard to the Abuse of Process, my paragraph 11, would it be possible to let me have some wording that I could use there.

If you have read the Abuse of Process thread (by beamerguy with comments at post # 14 on that thread by Coupon-mad) you will have seen the words to use. Also read a thread by user CEC16 as this outlines the appeal (failed) recently.
