  • From what I am reading, this does not look favorable.
  • I have sent email to DPO at Claimant office, requesting for copies of PCN and anything else they have on the file. One problem might be for me to take photos at the car park as the company making the claim is no longer in charge.

    What are you reading? Do you mean the fact that the vast number of court defences assisted by the forum (99% reported by Coupon-mad) are successful?

    So is it the 1% failures that concern you?

  • More a case of not having copies of the parking notices to contest their placement. Does it make a difference that the claimant is no longer in contract at Varley Park?

    have you tried the goback feature in GSV ? (time machine)

    have you tried googling for pictures other people may have taken

    the pictures should be in their evidence pack a few weeks before the hearing anyway, so you put them to struict proof of the signage and placement at the time of the incident

    they have to prove their opwn case to a judge, so you do what the police do

    Accept nothing

    Believe nothing

    Challenge everything


    as easy as A B C (as The Jackson 5 once sang)

    1 that the driver was a freshman and 2 that the parking company are no longer responsible for the car park. Another system is in place.

    I doubt the freshman newbie approach would work, the PPC would argue that the signs were there to be found and read , ignorance of the law has never been a defence

    stealing would still be stealing even if you did not know that stealing is stealing

    if the parking regime existed at the time, which it did, then subsequent changes have little or no consequence


    and this has nothing to do with the driver, I told you that earlier, its your name on the court case, you are in the dock and they are not taking the driver to court, its you they are taking to court, as Registered Keeper, you need to drill that simple fact into your head


    your car , your responsibility


    their responsibility in law is to prove that YOU are responsible as keeper for the actions of your vehicle

    1 - no, except to say that the keeper was not the driver (if you are the keeper/Defendant?) and except if the driver was loading or unloading stuff, moving in/out, rather than the car being parked & left for a longer period.
    2 - Yes, you can say they were removed due to complaints.

    Unless a person has kept copies of the POPLA appeal photos provided of the signs, no-one has the signs until later in the process. EVERY case is defendable and OPS lose pretty much all the time, and me and ParkingMad attend some in Brighton.

    If you are struggling, why not give your address for service as the Brighton address when defending this claim, and send me a pm as I attend and speak for people in Brighton court, for free, to beat PPCs.

    You would need to put a covering email to the CCBC 'change of service address' and similar to Gladstones (or is it DBL or BW Legal who filed this claim?) but I can probably help with that around the other dozen or so OPS cases I am juggling right now in my own time for locals (and fitting it around real life, and family, and picking up my lot from Uni, and then Xmas...)

    Where is the Varley Park site? I am not familiar with it. Send me a pm.
