Yes I am helping about 25 people v OPS by email and hope to help you all with WS & evidence and in court if I am around.

What can be good as well is, once we get some court dates, I will invite Defendants to come and watch a case a few weeks/days before their own hearings at the same Court. Helps you all get familiar with the building, security, signing in with the Usher, the Judges and the rooms. And hopefully most will see interesting cases and wins for Defendants, although it is never guaranteed of course and is down to the evidence and Judge.

Anyway, I gave the above dates for you to cross out. Put it as if you are 'on holiday'. Don't mention me, no need. I am not a witness. You are the only one who is unless you are bringing the driver or family member as a witness for some reason.

Dear forum,
This morning at 1030 my case was held by telephone at CC Brighton. OPS were represented by an employee and I by Coupon-mad as a lay representative. All parties were introduced to the judge who then suggested that CM could not represent me if I was not present
When I spoke he agreed that I was present. Very nervous moment for me. OPS presented their case and referred to a number of documents that their solicitor should have also sent to me and the court, 14 days prior to the hearing date. Several pages referred to by OPS were different to those that I had received and when CM and I said that we were having trouble matching the documents mentioned by OPS, the judge realised that OPS legal team had submitted the documents later than 14 days before the hearing. In addition, we had different sets of papers as evidence in support of their (OPS) claim. The judge described the options available to him and mentioned an adjournment but went on to say that due to Covid 19, courts are very behind and that as OPS had, with ample opportunity and experience to get it right, effectively wasted everyone's time, the case was dismissed.
To say I am relieved would be an understatement.
I am taking this opportunity to thank all the members of the forum for their support throughout my ordeal but most of all I would to say a big thank you to CM and ParkingMad. They have guided me through the entire process and at times it was very stressful. If you are reading the parking forum for the first time, be encouraged by what has been achieved with this and many other parking cases. When you think its pointless and easier to pay... write your situation truthfully on a new thread and someone will pick it up and hopefully you may achieve the same outcome. At least local council parking is usually clearly defined. Parking on controlled private land seems (to me) to be deliberately intimidating and should be challenged.

And before anyone asks, I hardly had to speak as we realised straight away we didn't have the same bundle.  DCBL had posted  a hard copy 125 pages to basher52 and never emailed it, yet had emailed a bigger bundle to the court (late).

And no costs were allowed.  Judge wouldn't hear of it.  BUT HEY - ANOTHER OPS ONE BITES THE DUST!

Great to read this, yet another procedural oversight thank to their arrogance and expectation of the "little guy" caving in to the stress and pressure, and it is easy to do. Well done for you not doing so!! This brightened my day.
