County Court Business Centre - UKPPO

Hi I need help to defend parking ticket Money Claims Online stage.

From the beginning. I have been picking up customer 7.07.2019 from the Hotel on private land (Hilton on Wembley) where previously there was no signs about maximum stay period. Customer has been late so I was waiting there exactly 33 min where I could only 20 due to their signs.

I get PCN from UK Parking Patrol Office Issued on 12.07.2019. In appeal I kindly inform them about situation and asked them to cancel it as the driver has been working and waiting for the customer from the hotel etc. obviously they refused and asked to pay. I havent said who was the driver at the time.

I said them that in this case I wish to be heard in court and to not try to contact me other way.

On 16.08.2019 another letter to name the driver, or pay. I ignored it.

Here is your link made live, but it contains nothing! "Online claim money something" is MCOL and is real court papers, i.e. a claim form. It needs dealing with, NOT ignored. Did it come from the Northampton CCBC?

These are not fines and it is a normal court. It is a civil court and they are claiming breach of contract. Please do some research, read the stickies/FAQs, and famliarise yourself with the rules of the game. Ignoring court letters can be very expensive.

[FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, it can cause the scammer extra costs and work.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

With a Claim Issue Date of 18th November, you have until Monday 9th December to do the Acknowledgment of Service. If possible, do not do the AoS before 23rd November, but otherwise there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.

Having done the AoS, you have until 4pm on Monday 23rd December 2019 to file your Defence.

That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.

When you are happy with the content, your Defence could be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. No need to do anything on MCOL, but do check it after a few days to see if the Claim is marked "defence received". If not, chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are trying to keep you under pressure. Just file it.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

Here is your link made live and this one works. That is an official claim form from Northampton CCBC and needs action as per KeithP's post.

Your best bet now is to read the NEWBIE sticky post # 2 and look at the 17 pre-written defences you will find there. Pick the one that most nearly suits your circumstances and adapt it to suit.

You could also try a forum search for situations similar to your by using the advanced search and using taxi pick up drop off or similar as your keyword(s). Change the radio button from threads to posts.

Hi guys. I did AOS, I have logged in there and everything seems to be ok and received. The only problem I have now is to find proper defence as to be honest after long readings I cant find any point I can grab and use to sort out my matter.

They sent all letters on time, I gave them info that I was the driver so keeper defence is not an option, I wrote email to landowner who directed me back to UK PPO so they dont care.

To be honest if there is anyone who can have a look and try to find anything which I can use it would be great.

Only thing I was thinking to use is grace period at the site, It havent been specified in the first letter, but they described it in second one - no grace period aplied for this site.

I cant see any proof that the signs were there at the time of contravention, this is where I would base the defence, is this good idea?

I have read so many defences but I cant find any similar case where I was serving customers on the site, and their actions literally caused the problem ( their delay).

    Please help.
