Dear Sir or Madam,
I am writing to complain about the release and misuse of my data to TNC Collections t/a Credit Investigation Services from whom I received an unlawful "notice to issue summons" letter. Please find a scan of the letter attached.
I wish to make a formal complaint about this company in regard to a vehicle registered to me being parked in an NPE operated car park on behalf of the Co-op food stores.I wish to complain about and draw your attention to the poor communications the firm you have contracted have sent. The letter makes several threats, including threatening court within 72 hours which is illegal and breaches BPA code of practice. Clearly here, the letter is designed to frighten and intimidate the recipient into paying an invoice they are not legally required to pay. Furthermore, they fail to provide the full and correct company name, which breaches the Companies (Trading Disclosures) Regulations 2008.
Moreover, they are illegally trying to charge £25 for a SAR and NPE have shared my data between various changing company names (CIS/ TNC Management).
As IPC members, I would like to ask that you cancel this PCN as the IPC Code of Practice 13.2 states that a 10-minute grace period should be issued to motorists, and this PCN is a breach.

You have written to BPA (as advised by C-m) but I fail to see why you have then mention IPC in your letter to NPE. Am I missing something, are there two PCNs involved, two different car parks. I have not gone back through the thread.0

The BPA are on notice that TNC and their alter egos are issuing letters that impersonate authority (summons) and issue threats that are nor clear or true. And that they try to charge £25 for a SAR and that the data seems to be being passed around between different companies, including another one given as the 'DPO email' on TNC's privacy page.
TNC are a BPA member, at the moment at least. Their letters are diabolical and I was so horrified that this dross was going out that I reported them myself to the BPA to start this off, and needed this poster and the other person I am in touch with, to contact Gemma themselves to show the letters.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I am a loyal customer of yours for many years now and have always found your company and the people who work there, very helpful.
On (DATE) I shopped at your coop branch in XX.
I was parked for a total of 8 minutes, bearing in mind that the code of practice allows for a 10 minute grace period for users. I frequently do my weekly shop at this store and use the post office service there on a frequent basis as well.I have subsequently received a somewhat threatening Parking Charge Notice from National Parking Enforcement Ltd - ref no. xxxxx.
I am so disappointed in your company in using these people. Parliament is aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019, a Bill was enacted to curb the excesses of these companies.
Using them is not something I’d expect to be in line with the ethics of the Co op. I was of the opinion that the ethos of the company was above this kind of treatment of their customers.
I would like to think that as a responsible, honest and thoughtful company you would like to keep one of your loyal customers. Therefore, I am asking that you have this notice cancelled.
I’m sure you understand my need to keep my family as safe as possible and it would be hard for me to remain a loyal customer if this is not resolved.

Hi, I know. I did contact the main CEO of coop but unfortunately they do not deal with the east of england co-ops. Therefore, I have to contact their CEO.

Thank you for your patience while I investigated your complaint.
I can advise that we have advised the Operator regarding the way the letter is worded and presented and changes will be made.
Due to the effects of COVID-19 we have agreed a timeline for these changes to be made.
In view of the corrective action agreed, I have closed the investigation.
Thank you for bringing this matter to our attention.
