Hi,
We've read through the newbies thread and faqs but we feel as though the generic appeal letter does not apply to our case and we wanted some advice on which template of appeal letter we should be using/ what to include.

We parked in a co-op car park for a total of 8 minutes. The car park is clearly signed tbh saying that it is only for co-op customers. Next to the co-op is a Tesco, where we went to purchase something. We then proceeded back to my car and left the car park.

We received a PCN-Notice to keeper (on 3/10/19) from national parking enforcement (NPE) for being a 'non-patron'. They use the cctv parking eye where they have pictures of walking to the Tesco and back.

We was just wondering what we should include in my letter of appeal and on what grounds would we be appealing? We could write a letter to the co-op manager like the other success cases, however we're not a customer there.

Any advice would be appreciated. This is my first ever parking ticket and we're just a little unsure on what to do.

    Send the template unaltered in any way. It applies perfectly to your situation. The idea is that it is recognised as being from here. It also does not give away the identity of the driver.

    Always always try for a landowner cancellation.

    The generic appeal template in blue text from post 1 of the NEWBIES fits your case precisely. It's called a one size fits all for a very good reason.

    You should edit your post to remove information about who did what. Only ever refer to The Driver and The Keeper, who are two different people. ;)

    I bet the signs in the Co-oP car park were not clear. You have already told us they are forbidding and therefore incapable of forming a contract. Neither is there any "consideration" being offered to non Co-oP users.

    "parking eye" is the name of a parking scammer, not a type of camera system.

    Therefore you approached this as if it all made sense! But as you may have gathered by now, the process of contesting a parking ticket from a Private Parking Company is not transparent at all.

    You've come to the right place for the information you need to tackle this. Starting with the standard template appeal. Have a read around the forum, including the Newbies' thread.

    Appeal to NPE as Keeper

    Complain to the landowner or retailer as Keeper or as registered keeper , this could be the store manager to start with , then the CEO , or both

    No I , no revealing who was driving
  • Despite reading "all through the newbies thread" you seem to have missed a few key things:

    1) Never reveal who is driving. - See you first post edit it now. PPC's read these for a
    2) "My case is different" No it is not. Just send the blue appeal, and prepare for POPLA or Ignoring if IAS.

    Can I suggest you have another read? This is a complicated area and it takes time to get up to speed.

    I hope you mean "When I send a letter...". ;)

    In any letter, use the word 'we'.

    E.g. "we visited your store...", or "we received a PCN..." etc.

    [FONT=Times New Roman, serif]Nine times out of ten of these tickets are scams so consider complaining to your MP, it can cause the scammer extra work.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

  • Hi everyone. Quick update, I have since ignored all letters. However, I have received a letter 'intention to instruct solicitors to issue summons'. Is this just another threat? Is there anything I should be doing in terms of appealing or do I have to just wait it out?
  • If taken to court will I have a case in terms of a grace period as the charge was for 7 minutes? Thanks for any help in advance :)
