The notice has a signature of the company name (not a person) printed in Comic Sans MS font. Does that have any impact on the validity of the discontinuance? (We've known CEL to pull stunts like this before to trick a defendant into not turning up so they get a default win. Should the OP verify this with the court?)0

They should receive confirmation from the court - in due course.DoaM said:The notice has a signature of the company name (not a person) printed in Comic Sans MS font. Yes and maybe send in their costs schedule and point out how late this discontinuance was and that this seems to be unreasonable conduct so he/she wishes the court to use discretion to consider a costs award against the Claimant, who was already in possession of the D's summary costs assessment (filed & served on xx date) and being a serial litigant, knew of the risks of ureasonable conduct by extremely late discontinuance.

So i have just rang the court and they have confirmed discontinue of the case but because cel wrote to me the court didn't have to.
I will now be moving onto D_P Dance stage of appealing, just wondering how long can i take to appeal0 -
What do you mean by "appeal"? You won
You appeal a judgement
If you mean you are looking to take them to court, then you have 6 years to pursue an alleged debt.2 -
Check with MCOL in a few days time to confirm the status. I am surprised the court don't confirm themselves as this leaves the whole process open to abuse.Abzg2k19 said:So i have just rang the court and they have confirmed discontinue of the case but because cel wrote to me the court didn't have to.

Have I mentioned an appeal? I do not recall. How can you appeal, you won.You never know how far you can go until you go too far.0

You cannot take this lightly, if you send an LBA, that is free but they are unlikely to be frightened into action or paying you just by receiving a letter. You need to be prepared to follow through with a claim (which you can do via MCOL) and it will cost an initial £25 filing fee, then hearing fee if it gets that far. Look into it by asking Auntie Google.1
