Real or fake N1 Form - No POC?

Hi All,

I really appreciate any advice on this one as I'm in totally new and concerning waters with regards to County Claims. EDIT: I've just tried to upload the letter but as a new user it won't allow me to sadly.

I received a 'Claim Form' this morning and have no idea whether it's real or fake. Everything looks photocopied (seal/logo etc) If it's real I haven't a clue what I'm in debt to? I've got no work done today having been trawling through the newbies thread and other cases to figure out what to do next.

The letter states the claimant to be Civil Enforcement Ltd with docs to be sent to them too. It has the password details for moneyclaim but whilst it details charges, it doesn't say what they're for at all.

Do I acknowledge the claim on MoneyClaim now without knowing what it's all about or do I wait until the POC arrive (letter states to be received in 14 days)?

Thank you so much, the information on here so far has been amazing!

V.

NEWBIES - HOW TO UPLOAD LINKS TO PHOTOS/SCANS TO MSE

To upload a photo/scan link, you first need to host it on a free photo hosting site (like Dropbox, Imurg or Tinypic), copy the URL, paste it here, but change the http to hxxp and we'll do the conversion. Newbies can't directly upload links to photos/scans until they've a few posts under their belt.

Oh ... and using a phone to browse the site can cause problems.. so please try a laptop/PC

    Hi Ralph,

Thanks for your message, no issues posting via IMGUR but as I'm a new member the forum won't allow me to make any posts containing links.

I don't think we need to see the Claim Form.

What is the Issue Date on the Claim Form?

Technically the Acknowledgment of Service is acknowledging the service of the Particulars of Claim. As your Claim Form says the POC will be provided within 14 days, might be a good idea to wait a few days before doing it.

You are best to assume that it is real , but maybe wait 5 to 8 days following the issue date before doing the AOS online using the password provided, on the government gateway website , so should be ok to do so asap now if the issue date was the 23rd

Meanwhile email a SAR to the DPO at CEL to get all the documents and pictures and data about you and your vehicle attaching a copy of the claim form plus a copy of the V5C log book as proof of ID under the GDPR

Start drafting your defence and post it below for critique asap

Hi Red, thanks for your reply. Based on the issue date, today is day 8. As a car enthusiast, I have had a few car changes, currently I have 2 cars registered to me so I haven't a clue which details to send off for the SAR.

Issue date states 23rd September 2019.
With a Claim Issue Date of 23rd September, you have until Monday 14th October to do the Acknowledgement of Service, but as said earlier, maybe leave it a few days before doing the AoS. To do the AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.

Having done the AoS, you have until 4pm on Monday 28th October 2019 to file your Defence.

That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.

When you are happy with the content, your Defence could be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.
