Real or fake N1 Form - No POC?

  • Thanks Ralph, I just wanted to post so that if it was confirmed real or fake, future searchers could find an example of the form and get clarification.

    If the mcol password works , then it's not fake , I would say it's real , so treat it accordingly

    As you have no idea which vehicle the firm refers to , then use a redacted copy of a utility bill with your name and address on it , plus a copy of the claim form

    And point out THEY must know which vehicle this claim relates to!

    If it states further PoC are to follow then technically you should not Ack until AFTER the PoC arrive. But this puts you in a bind - and so to be safe i would ack after a week of the 14 days time limit.

    Its been a LONG time since CEL have used "further PoC to follow" .
  • Thank you all again for your help so far. It turns out that the letter was very much real (despite the shoddy looking paperwork). With the help of your guide I've submitted the acknowledgement on MCO but I'll admit this whole thing has me petrified, I haven't had to deal with anything like this before and am feeling very out of my depth.

    Civil Enforcement send their POC details through and it turns out that it's from November 2018! I parked where instructed by my estate agent for around 15 minutes (ish) whilst I signed my leasehold agreement. I didn't even notice any signs as the agent told me where to go and park.

    Where would I stand with this if I was given permission? I can't believe that something so long ago is only rearing up now - not to mention that CEL's claim is at £256 when I've only just heard about it all!

    Any help would be hugely appreciated!!!

    So you relied on a promise (was it from a company that could make that promise - their land? You may need to phone & ask them).

    If so, search the forum for promissory estoppel defence.

    Reading other people's defences and successes (ordinary people like yourself win here every week!) will calm you down, and you can plagiarise their defences.

    Nine times out of ten of these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies
    You never know how far you can go until you go too far.
  • I'll have to confirm if it was their land, it was a row of parking spaces behind 3 shops - I have sent the estate agent an email requesting a letter head confirming my appointment that day and my permission from them. I'm hoping that this will be a good start. I just have to keep my fingers crossed that they will be compliant and help me out!

    Below is on google but that was in 2015 so I'm assuming the parking enforcement wasn't in place then.

    If Beresfords are the estate agent it looks like they share the back bit, or implied access rights to it, but you'd be guessing and it's probably not owned by them.

    Rest assured EVERYONE has a case v CEL. EVERYONE. The claim is inflated.

    I've been to court. I enjoyed it and unless you go into a large court room (occasionally happens - looks like Judge Rinder with the DJ sitting higher) it's like a formal meeting, that's all. Like an interview, dress smartly.

    Not scary but we know (and Judges know) that people are nervous in that environment.
