As above , I would be adding the abuse of process paragraphs to expand the spurious costs , by reading recent defences and witness statements and copying them , renumbering your WS accordingly
Look for judges Jones , Giddins , Taylor and Grand0 -

Oh dear, I thought (along with others) that you were trying to compile a Witness Statement (given that your post # 29 says Witness Statement) so apologies for leading you down the wrong path. Go now to the NEWBIE sticky post # 2 and look at some (or all) of the 17 pre-written defence examples. They will give you a start into which you can add the promissory estoppel and the Abuse of Process, along with signage and landowner authority.0

Thank you, yes, it means that I have time which is good although with zero knowledge of the law in these matters I'm finding it very stressful to find a suitable defence template. Not to mention make sense of the ones that I am reading in order to find a way to make them relevant.
My productivity at work is suffering because I'm constantly thinking about how to begin to fight CEL over all of this. Such a nightmare!0 -
The latest on this one is that I applied for land registry details and sent a recorded letter to the land owner. It was received yesterday and signed for by someone in the building but I can't guarantee that the land owner will ever respond.
I have until 28th October so only a few days to put together the defense (which is still baffling me!). Would you reference the land owner letter?0 -
Make reference to the fact that you are seeking landowner evidence (not yet received), but the actual response (if you get it) is only relevant to the Witness Statement (a couple of months away) which should incorporate any and all evidence.Would you reference the land owner letter?

Have you read the concise defence example put together by legally qualified poster bargepole , or the 17 linked defences covering most types of parking scenarios (find one closest to your circumstances and adapt to suit), which are all contained in the NEWBIES FAQ sticky, post #2?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
