    Then file it (the completed N244, the fee and your Witness Statement) tomorrow at your local court with a covering letter headed - URGENT - PLEASE PUT THIS APPLICATION BEFORE A JUDGE THIS WEEK - BY 20TH SEPTEMBER asking for the case to be put before a Judge to stay the Warrant of Control in view of the set aside application.

    Attach a copy of the Warrant of Control and maybe phone the local court in advance (in the morning) to find out who to hand it to and to get them onside to help you.

    Be friendly and polite and explain why the matter can't go slowly to the black hole of the CCBC! The court clerks are there to assist court users, so get them to confirm how to get this before a Judge this week.

  • I don't have £255 just lying around though and feel I need to probably pay the fine on a payment plan to make it affordable initially.


    I am confused on what to write on a witness statement also. This is not easily found on this site despite looking through the newbies thread at the post.

    If I chose to pay the fine can I get the CCJ set aside at a later time and what happens to the CCJ? Thanks

    County Court Baliffs are like !!!!! cats if you know what your doing
    CM is right with regards to what to do with your car etc, just keep it away or locked in the garage
    They really are powerless to do anything and have no right of entry
    Personally and if it was me (this is where is a disagree with cm) i would just see of the bailiffs and work to get this set aside.
    If your determined know what your doing then these bailiffs are a push over.

    I've literally just replied on a typical set aside thread that you could have read this afternoon.

    Read today's threads - we have to! Everything is already here for you and done a hundred times very month. Searching the forum reveals the ENORMOUS resource offered, with new examples galore every week - it is not just about the NEWBIES thread.

    Nope, and your credit remains ruined for 6 years. A 'satisfied' CCJ is not the same as a WIPED one following a set aside hearing.

    Not really, but I do not have £255.

    I want to get this set aside but I just don't have the funds to right now and clearly not enough time either. I cant have bailiffs turning up to my house.

    So you would rather have no credit ability for 6 years? Paying it (in instalments or otherwise) does not repair the CCJ it just marks it satisfied - no good to anyone unless you want to live in a cave and not even change your phone contract or borrow any money for 6 years.

    I did tell you how to stop bailiffs, by doing what I said, tomorrow.

    Maybe you qualify for help with court fees if you are on a low income? Might be free for you? Google it and see the income threshold, it's higher than you might think.

    I will try to get this set aside tomorrow by doing what you said and going to the court etc. I will respond here when I have done this.

    Do you know how payment for the court fees can be paid? Can it be paid on a credit card?

    You MUST have £255 then? Yes it can be paid on a card.

    Not being funny but just borrow it from family if not, and get this thing stayed and some breathing space without bailiffs, to remove that CCJ.

    You may have to speak to more than one court clerk to find the helpful one who promises they will put it before a Judge this week...
