  • I moved out of my mums officially when I was 19, I'm now 25. I cannot prove I have been at my nans....

    So I'm going to tell mum to just call council and update her circumstances. I'm moving back in a few months so may aswell do it now and hope they don't investigate as I haven't got leg to stand on.

  • The truth has been told. You guys are adding to my mums stress and mine, I am simply wondering whether mum will be liable for 6 years worth of council tax debt or whether she can update it and pay the full rate.

    I'm not sure why you think this. You came for advice and you were given it based on everything you said.


    If she's been claiming single person discount for 6 years and they think you've been living there for all this time and you can't prove you haven't then yes, she may have to pay all the money back.

    This will go one of two ways;
    1) The council accept the evidence you are not there and it is not your 'sole or main residence'.
    or
    2) They will determine it is your 'sole or main residence'.

    They run relatively regular reviews of discounts and match against who is associated with an address. This is, in most cases, how potential issues come up for investigation. So far people have pointed out possible inconsistencies - these are the sorts of issues which would be considered by the council when they make their decision.

    You need to be straight with them and tell the truthful situation, if there's nothing to hide then there's no issue and it should be sorted relatively quickly. Ultimately the decision is the council's - if they believe you then the discount stays, if they don't then it goes.

    I will be moving in to my mums in a few months, should I just tell my mum to write a letter stating I am currently now living at home and to update the records?
    When investigating discounts that is one of the biggest flags - "I just moved back in, honest...". It was something I'd hear on almost a daily basis and almost always just after the discount had been queried.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
  • I think you need to take some responsibility.

    You should of had everything changed to the address where you were living. Makes more sense.

    As well as this you should of been on the electoral roll as living at the new address and been added to the council tax bill and paying your contribution direct to the council.

    You wouldn’t of been in this mess now.
