I have to note the letter says that the parking charge remains unpaid which would suggest a NTD not a NTK. Very odd.
I have to say I am getting conflicting advice everywhere.0 -
So after forty posts we have come back to the beginning - questioning the one size fits all template.
Do what you think best. I'm out.0 -
You have missed the whole point(s) behind that appeal, and why you are advised not to alter it
And the other one that has been repeatedly told you - any appeal to IPC companies is futile!
I'm off to catch up with Keith!0 -

Sorry if I am a bit thick but I dont understand why an irrelevant response beats a relevant one. What am I missing please? I am new to all this rubbish so no need to be unpleasant, it is uncalled for.
The appeal is doomed to fail. The IPC rejects all appeals. It does identify you as a difficult target though so discourages court action.
It's explained in the Newbies thread which is why people are getting exasperated as you keep being told to read it but clearly aren't taking that on board.0 -
ffacoffipawb wrote: »Doesn't my relevant response do the same though?
This will be an appeal to the company.
I will use the template one to IPC if it gets that far.
I give up too. Sorry.0 -
Why would you do that?ffacoffipawb wrote: »I will use the template one to IPC if it gets that far.
That's not in the guidance from the NEWBIES thread.0 -
Why would you do that?
That's not in the guidance from the NEWBIES thread.
OK thats understood.
However the thread does state:
Want to dig deeper? Check the compliance of your Notice to Keeper, if the PPC is citing 'keeper liability' under the POFA. Here's a link to Schedule 4 of POFA 2012 which applies in England/Wales only (look for the words shown in paragraph 8 if it's a 'windscreen ticket followed by a NTK', or the words in paragraph 9 if it's a postal PCN only)
Hence the reason I was sending a different reply due to perceived non compliance. They are quoting POFA.
Anyway, I think I will use the appeal here, regardless of advice elsewhere, even though the points are irrelevant. I bow to what must be the better advice here.
I will keep the POFA breach to myself for now and use in court if necessary.
It just seems wrong, intuitively. I just dont get it. Perhaps because English is not my first language.
Not going to reply to them until near the 28 days.
The driver will not be named.
Wonder how much 60 x £1 cheques will cost them to bank. I have plenty of accounts with chequebooks lol.
If I hear any more, eg LBCC, I will update here.0 -
Surprise surprise, the UKCPS scammers have rejected my MSE template response within a day of submission. Guess it's a 6 year waiting game now. I have no intention of appealing to the IAS kangaroo court.
It is a shame that this company have no pay machines that people can vent their frustrations on. Ahem.
I guess I could ask for GPDR data held on me every month or so to waste their resources. Costs me nothing, costs them effort and stamps.
======================================
Thank you for your appeal received on 26/08/2019 regarding the above detailed Parking Charge Notice (PCN). We have reviewed the case and considered the comments that you have made. This appeal has been considered in conjunction with the evidence gathered and our records show that the PCN was correctly issued as your vehicle was parked in breach of the Terms and Conditions of Parking.
Vehicles parking at the above location must be parked correctly within a marked bay; in the car park. There are numerous signs at the car park which state that vehicles should only be parked where a marked bay is present and must not be parked on, over, out of the lines forming a marked bay or, in a bay marked for a specific vehicle type i.e. Ambulance, Police, Coach etc. Parking out of marked bays can cause obstruction, inconvenience and safety hazards to other users of the car park. By parking the vehicle out of a marked bay the driver contractually agrees to pay a parking charge.
We are therefore unable to cancel the PCN as it was issued correctly. We have now extended the discounted payment period by 14 days to allow you time to pay the discounted settlement amount. Please now make payment of £60 to reach us by 10/09/2019 or £100 to reach us by 24/09/2019. We must advise you that once the discounted settlement rate passes it will not be offered again.

If you believe this decision is incorrect, you are entitled to appeal to the Independent Appeals Service (IAS). In order to appeal the IAS will need your parking charge number (PCN), your vehicle registration and the date the parking charge was originally issued. Appeals must be submitted to the IAS within 21 days of the date of this letter.

Bog standard template non-specific appeal rejection (they all have them).
Nah! Your first one is free, but subsequent ones (covering similar aspects) and/or frivolous requests can be charged.I guess I could ask for GPDR data held on me every month or so to waste their resources. Costs me nothing, costs them effort and stamps.
All you can do is wait to see any next move of theirs. They will threaten court, we rarely see them follow through with the threat, but there has been the occasional foray.
I hope your user name doesn't include me in its sights! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
