County Court (VCS) Residential PCN

From what ive been told by the court this afternoon the fee has not been paid. I am awaiting confirmation from the Court as they appeared to be having IT issues.

This first one spells it Roche but the second one has the Judge as Roch:

I found those by searching for posts by Johnersh including the word 'Vine' but the second one would come up if you searched for the single word Roch (not 'VCS').

Am I allowed to list the Claimants WS once it has been received?

What show it here? Yes - but read other VCS threads first where others have shown it already! Saves putting up stuff that's standard and already covered before.

The WS is in, its lot longer than I imagined it would but Ive had to summarise my points and relate them to the evidence.

The data protection and undue process segments took quite a while.

Ill redact my WS and upload it to dropbox. Even if I were to fail it might be a good example of what not do :rotfl:

I have their WS. They have all sent a Notice of Intent to Relly on Hearsay Evidence?

Essentially its summed as follows;

1. We are an AoS of an ATA - The IPC. "Given the company's membership, it was evidently operating in accordance with the COP. I think my WS has hammered this with 5 failings indentified + DPA issues. I took the IPC COP and used it in evidence highlighting all failings I noticed and giving evidence in the WS of said failings - including images and docs etc.

2. It is essential to the companies business that it complies with the COP. :rotfl::rotfl::rotfl:

3. Reliant on POFA 2012 Sch 4 completely. No alternative is given.

3. PCN details are given in the WS. These are the "correct" details but dont match the Particulars of the Claim.

4. Management company contract from 2007 - no evidence of validity at the time of the event. The contract states the number of signs must be present is 32. There are not 32 signs on site, less than a quarter of this Id estimate - and thats across the ENTIRE which is about 1/3 mile long.

5.Signs - PPC has provided entrance and repeater signs. Entrace sign is a different sign to that from 2016 I have evidence of this from the listing of the property in 2016

6. Site map showing sign locations - The signs here are utterly made up and their own images show it to be a gross exaggeration. This is utterly misleading the court IMHO. Their own PCN sign map was already exaggerated and does not show signs at the site as this contract and given "evidence" suggests.

7. PCN Images Shows my permit in the car and the lack of signage around the car. :money:


8. Original PCN - uploaded incredibly blurry and worse than the scans VCS have given me. Given it contains errors Im going to argue this is deliberate.

No counters to my defence points in my initial statement, no challenge etc.

All in all feeling quite confident now.

I will redact all identifying material from both WS and dropbox them. Feel free to have a browse when I do.

Need to put my Skellie together now and my Statement of Costs.

I wish I knew how horrendous they were with breaches and DPA BEFORE my AoS - I would have counterclaimed.

Quick q - did you send the WS to the claimant AND hand delivered to the court?
Have they paid up now?

If you have chance, you cna highlight the fabrications in the skellie. Simple points - the map claims signs in x,y, z places but they arent there, see my evidence ref....

VCS WS aer always long, and ALWAYS terrible.

Yes, hand delivered today and the Court added case notes confirming the time it was handed in.

Regarding their WS..... Mine is longer. It's over 40 pages though much of this is IPC Cop, images etc. And not text.

I'll draw attention to the points raised above in my skellie and reference examples in my WS that demonstrates this.

Think that's about right.

I think theyre trying to persuade the court that their garbage, when its found out that theyve lied, wont result in sanctions against them.
Because "oh its only hearsay, we ddnt mean it" despite it being put into evidence under a statement of truth....

Hearsay means it is unevidenced, circumstantial.
