Yep. As others are saying it's nothing to do with the PCN itself but the nature of how they are treating me and my data I think tells a thousand tales of just what a bunch of scam artists they are.
Hoping the ICO confirm a breach.
Am I right in thinking that if they withdraw the case or the judge finds in my favour that they will have obtained my data from DVLA without probable cause and therefore fraudulently.0 -

They have the right to get the Registered Keeper's details from the DVLA simply so that they can ask the RK who the driver is.0 -

So even if there was no breach and I had complete authorization to have my vehicle there, VCS are within their rights to get my information from the DVLA? How does that make sense?
The DVLA wont give information out without due cause surely0 -

They are allowed because they belong to a ATA which gives them the right to access the DVLA ...... VCS belong to the IPC which is a scam set up by the incompetent Gladstones solicitors ...... sad thing is that the government knows it's a scam0 -
So im clear, VCS can therefore get any information from the DVLA they like as long as they have the reg?
Whats to stop them snapping pictures of your car on your drive and finding our all your DVLA based info?0 -

Here is just one quote from it. On page 3 it says:Release of information from DVLA’s vehicle register
The law allows DVLA to release information from the vehicle register to the police and local authorities.
Regulation 27 of the Road Vehicles (Registration and Licensing) Regulation 2002 also allows us to release data to private or public sector organisations and individuals providing they can demonstrate reasonable cause to have it. The release of information about vehicles and their keepers for such purposes is long established and was in place before DVLA existed. As the law allows the release of personal data we do not need the vehicle keeper’s consent to disclose their details.0 -
Exactly, "reasonable cause". This is where my question sits.
If I am successful in defending the claim, then depending on the points the judge agrees on it will be shown that they had no cause.
I dont deny the DVLA can share it, Im aware they can.0 -
I had a conversation with our legal team at work who deal with DPA events etc. If the court rejects VCS claim on grounds of contractual supremacy, signage or unfair terms then they had no right to get information in the first place. The DPA thread here suggests the same.
Im awaiting for the ICO to confirm the breach and then I'll take action as and when required.0 -
So, its been over two weeks since I wrote to VCS confirming a breach and asking for an explanation. I gave them time to respond and theyve refused to do so.
Ive sent a reminder today offering them a further 7 day - then ill be issuing a letter before claim.
Had enough with these fraudsters and clowns.0 -
I wouldn't be giving them any more time!0
