Brilliant report, great read, was like being there
This case now appears in the Abuse of process thread. You were abused. It is now in stone at the bottom of post # 1

Glad to hear you are not leaving it there.
There seem to be DPA and Consumer Rights Act breaches galore in your case, what with the data leak, and you said 'lying to the ICO' and supplying low res images and a false statement about the number of signs with the map, and just the fact that the permit was displayed all along, and the Judge agreed it appeared to be the case.
You had Mr Pickup, who Lamilad has beaten before:

A serial disaster.
Imaging being able to make money by continually just representing VCS.
You could tell, immediately, he'd given up. I saw no fight from him at all.0 -

Essentially, the ICO told them to contact me. VCS went back to the ICO and said they had responded.
The ICO then contacted me and said, VCS have contacted you and we feel there may have been a breach.
I responded to the ICO by stating VCS have not contacted me at all and are still committing breaches.
The ICO then responded by saying they believe a breach took place but that now they are confident appropriate measures are in place. They acknowledged VCS havent contacted me and they said they have instructed them to do so.
They have not 6 weeks later  Infact, other than responding late to the SAR, they have NEVER contacted me directly - NTK aside.
Ive raised the point with the ICO again today stating they lost and now it transpires they had no right to the information in the first place. Ive also complained to the DVLA and the IPC - just to cover all bases.
Interestingly enough, despite NOT disclosing the fact they had shared my data with any other firm (except DCB) they claim to have used debt collectors in their WS. Oh dear!0 -
Yeah, the DPA breach alone should be worth a fair chunk.
Get the IPC to comment on VCS fabricating evidence - under penalty of perjury - as well.0 -

I have since been advised that the "hearsay" comment is to stop exactly that. Explains why no one has really seen it used before - they knew what they were doing. Not sure how true that is, but the guy is a former barrister so
Im not sure the ICO would deal with false evidence either?0 -
ICO wouldnt, no
However you cannot sign under a statement of truth, then later say "oh no, its not".
You cannot present something as absolute fac t- like a count of signs - then say it might be in error0 -

Their WS is signed
"I believe that the facts stated in this Witness Statement are true"
So yeah, definitely something fishy. I did hammer this to the judge but she didnt seem interested. :eek:0 -
Hi all,
DCB have contacted me wanting bank details to pay me. I really DONT want to provide them or VCS any more information on me than they already hold.
Am I within my rights to request they pay by cheque?
Ive asked the court too but waiting a response....0
