    The claimant does not file a defence. 
    Dont use incorrect terms
    They will have filed a ws and evidence to support their claim

    Dear Sirs The judge who is hearing this case on Friday 30 October 2020, has reviewed the file and has commented as follows:-

     “In light of the volume of documents filed by the parties, a 1 hour time estimate is no longer suitable.  The matter has been vacated and will be relisted for 2 hours with a reading time of 30 minutes for reading and viewing video footage”

     Please do not attend Court on Friday 30 October 2020.  The parties will be notified of a new date and time for the hearing in due course

  • See this is where I think they may be confused. The memory stick I provided contained voice recordings from when I rang the police. I gained this from the secrecy of information act. I'm guessing it is that. I have the VCS witness statement and it didn't contain any footage. Not that it would matter. I'm just a bit of a worrier, and concerned they would try and manipulate cctv footage of some sort.
  • The main bulk of their witness statement was that I had adequate time to read the sign and leave site. (Which I couldn't as a road block was in place). The rest is a host of information justifying signage and how i became liable ect ect. Then trying to justify the 60 pound charge.

    If the claimant is going to rely on CCTV footage or evidence of any kind, they have/had to supply you with a copy already.  They cannot ambush you in court.

    Not only that, but they would also have to had disclose it at the SAR stage.

    I am in court tomorrow.

    Wish me luck! Any last minute tips or advice on how I should approach the day?

    I have never done anything like this. So have no idea what to expect.

    And any completed court thread tells you, if you search ANOTHER ONE BITES THE DUST.

    Have you provided your phone number as required for the phone hearing?  Highly unlikely to be in person.
