    No, thats completely wrong
    Without an order vacating that Order, it remains in effect. 
    Also, they never havea defence (or even a defense) - and theyre not going to get any better a claim against you. 
    Put it behind you, for now.

    So upset with this..

    Please don't get disheartened.  This is a remarkable case.  How very desperate VCS are.  They are going to lose this case, they know they will lose it, I doubt their reps will turn up, they are simply hoping that you will lose your nerve beforehand.

    Did you object to it being heard on the papers when you got that May Order?    Just checking, I can't recall!

    The hearing was vacated and changed to October, so that did mean the previous deadlines fell away.

    Yes I did :) I objected when I handed in my Witness Statement bundle, which was before the deadline. Also attached the draft order. I also emailed the courts to state that my reply has been hand delivered to them in regards to it being on papers. Thank you Coupon-mad

    You do not agree for the case to be heard on papers alone. You want a face to face hear (although you may end up with a telephone hearing).

    REASON  ...... you require a face to face hearing to ask VCS about the £60 they have added which you know nothing about.
    It's an alert to the court about Abuse of Process

    Reply and say no, you are not in agreement to your case being heard on the papers.  Use the words in the telephone hearings thread about 'on the paper's hearings and why they are unfair on Defendants v parking firms.

    It's weird because I did send that statement that you mentioned coupon mad. I then sent them an email saying I have handed the reply about the papers in with the witness statement bundle. Guessing they just haven't looked. Will reply in letter format. Thanks everyone. Grateful as usual.
