Law on brake checking someone

    I'm guessing he brake checked you because you flashed him.



    I do that, 3 flashes, 3 brake checks. I am doing the speed limit, bmw driver comes up right behind me and tailgates me. He flashed me 3 times, so i tapped the brakes 3 times, and continued driving at the speed it reduced down to. He then flashed me twice more so i hit the brakes twice more again and I'm doing 2/3 of my original speed and he can't go around me because it's a single lane road.

    Wrong answer. If you went around me (or me around him) i'd have been hit by oncoming traffic. Not only that but i'm sure if i'd have done that then you'd have said how unsafe that was, but since you're the one suggesting it it must be the correct move right?!

    So if you've already braked he would have to break very hard for you to even close the increasing gap between your 2 vehicles let alone "brake checked" you. Who's got the wrong answers now? Driving is simple, you need to get better at it. It's simple physics.

    Fortunately for you guys, i have the answer :beer:
    It's because we live in a me-me-me society. I can do what i want, i can have what i want, i can do and and have it when i want, F everyone else and you can all get out of my way because i'm the only one in this world that matters and none of you do. Don't even dare think about telling me i did wrong because you'll get a punch square in the face ... because i'm never wrong and can do what i want.


    Your story reminded me of an incident i had probably about 7-8 years ago now, maybe a bit more. This guy nailed it out of a petrol station. Weirdly he was also driving a premium German make.


    I sense a trend.


    Anyway i tooted the horn. It wasn't a toot like the wife would do where you'd barely hear it like you'd brushed it but it didn't last all day either. It was about a second.

    He pulls in at the junction which we immediately pass so i drive on by. Thing is he only pulled in to allow me past. He then proceeds to hug my bumper. I don't just mean he drove pretty close, i mean i could barely see his bonnet never mind his number plate. You'd have probably struggled to get a sheet of paper between us. God knows how he didn't touch me. I didn't dare slow down never mind touch brakes. He was weaving crazy left and right, flashing his lights.

    I looked in the rear view and the car was pretty much full. They all had hi-viz vest type things on & looked like big burly builder/HGV driver type guys. Yeah i know that's stereotyping .... shoot me.

    This carried on for a few miles until i got to a roundabout. I went round it a couple times and then back the way i came. He got bored and drove off. Probably the scariest time i've had behind a wheel.

    Your unreal, honestly. Because he had a hi vis vest he looked like a hgv driver/ builder you know there's more than them that use them. God I've seen tesco workers the same. You can brake test who you want, someone goes into the back off someone there to blame.

    Car full or driver, pretty much full.

    Did he chase you round the roundabout?

    The answer to your question is: the car pulling out is accelerating. This must be the case. You said you were braking. This will be the case if you haven't lied. Therefore the gap between your vehicle and the car pulling out is increasing. This must be the case if everything is how you said. So brake checking you cannot be possible if they are pulling away from you, is this not how it happened?

    Ok let's paint a scenario...


    You're walking along. As your next footstep is about to put you level with me on my side i sidestep and stand in front of you.


    Now is it your fault for being too close to me??
    Or is it my fault for being an idiot and stepping out as you're getting so close to me?


    Can't have it both ways so which will your answer be?



    I'm not commenting on your driving as I have not seen the footage, more than welcome to post it for analysis, but the scenario you describe is a common problem of modern motoring. People now drive essentially looking at the license plate of the car in front of themv rather than looking ahead to spot potential hazards. Appreciate I may take a different view of this situation having undertaken different training but without seeing the footage I would presume something like this may have happened


    The other car was either approaching the junction while you were still travelling or they were at the junction and stationary. A stationary vehicle doesn't suddenly become mobile without giving off signs or signals of some description, the driver looking around quickly for a gap, the engine being revved as they get ready to pull away, the vehicle rolling etc. Again, not having seen the footage or been present at the time, it would be at this point it might be worth taking some pracutionary action, changing your position within your lane to alert them to your presence/make yourself more visible. This would be the time to beep your horn as a preventative measure to alert the other party as opposed to after the event in anger (not suggesting you did this by the way). If neither of these gave the desired effect as a last resort lift off to allow yourself extra time to take action if they do pull out. Once you are passing the vehicle you aknowledge the fact that they did not pull out and then both go on your way to a less stressful day.
    Some people don't exaggerate........... They just remember big!
