    Sorry, @DE_612183 I didn't get you. 
    Normally these guys get spanked in court first time around, in your case they thought they'd won - but then it got taken away from them and they have to try again ( thats the way I read it ). So it must be harder for them to take, or sweeter for us!

    He/she means the victory is all the sweeter because DCB thought they had won and could keep all your money!!  Then along comes a Judge who pulls that rug from under their feet, haha!

    You know when you first asked VCS and DCBLegal or Ltd to pay them, what exact date was that? The date you first rang them?  I think this is why it was set aside, due to bailiff fees being added prematurely in February, yet the writ wasn't dated until 18th March:
    When the defendant contacted the DCBLtd on 24/02/2022 they asked me to pay £940.04. This was inexplicable and almost £200 more than the default judgment yet only days after it, at a point where no costs can be added. 

    Absolutely appalling conduct IMHO.

    If they hadn't been so damn greedy they could have legitimately banked the £750 ordered by the court, and you would have been unlikely to have been able to do anything to get it back.

    Their own greed has bitten them!

    @SoJacob, when you get the written Order from that Judge (next month) please can you show it to us?

    It was DCBLegal (not Ltd) who -according to your account back in Feb - tried to make you pay £940.04 prematurely, wasn't it?  I recall you getting muddled and ringing DCBLegal thinking they were DCBLtd, and I think the solicitors allegedly demanded the higher sum?

    I reckon you should be reporting DCBLegal to the SRA for this, but you will need the Judge's order to back up the allegation of wrongdoing.

    Something for you to do in November: it's only an online complaint thing, doesn't take long.

    But defence comes first.

    Maybe take a day off all of this then show us the next draft of your defence facts by the end of this week? Having added in the stuff about the Equality Act 2010 and the fact the byelaws allow for some stopping events and the byelaws and the fact it's a public highway override any third party purported contractual agreements that absurdly twist a prohibition into an offer to pay VCS to be allowed to breach the byelaws.

    Yes and yes. 

    I will try to do the defence by this week or mid next week. Have few hospital appointments coming up. But hopefully I get some time on Sunday.

    It looks like you are getting back the money they "persuaded" you to pay, the judgment is set aside but you now have to defend the underlying claim.  You need to file and serve a defence and you only have a few days.  The date given by the judge is a Saturday - weird!

    Ok. I got it.. my whole family including myself are sick high fever. I’m running out of time.

    Please could you have a look into my draft and advise what else to be added? 
    My husband does have some issues with his knees and has been waiting for a surgery. I can get those evidences from his hospital records.
