(d) there should never have been a CCJ at all because you tried to pay the sum ordered by the court, within the 30 days that the Order allows. You were not admitting liability
have I got this right??
I tried to make the payment after I received the default judgement. I abroad when I received the claim form dated 27/1/22 and default judgement dated 18/2/22. On the default judgement (dated 18/2/22) notes it talks about the registering judgement in the public register and will be removed if I pay it in 30days. Which I did and was removed.0 -
Oh dear!! I am running out of time and my heart beating so fast....
But this was issued within the 30 days following the claim form.0 -
I think I now understand!!! SORRY. DCBL should not apply for writ within 30 days of the claim form..1

Case is set aside!!!
The judge asked me 2 questions
1- why I did not mention about the PCNs in my witness statement. I then started to stutter, couldn't get words. I then mentioned that I have a draft defence where I have mentioned about the PCNs and apologised that it is not mentioned in my witness statement. I briefly mentioned about the bylaw of the land. Judge seems not interested to see my defence.
2nd question asked by judge was- why I took so long for to apply for n244. I explained- I decided to pay at a point to come over the stressful time during pregnancy and was looking for mortgage. However, DCBL demanded to pay more than the judgement explained that I was unsure about legal procedures and required time to understand it.
During the hearing I was nervous, I think I covered all points advised by @Coupon-mad, except the costs. Judge told me that she won't be ordering to pay the application fee as this was not the claimant's fault as the claim was served to the right address.
Case set aside- not under the CPR 13.3 but the fact that CCJ applied within the 30 days of time period
judge ordered DCBL to return the money they demanded in addition to the judgement (about £200) and defence in 14 days.
Please kindly continue help me with my final defence.
