Le_Kirk said:Have you read about set-aside by consent £108 court fee and contested set-aside £275 court fee? Which will you choose? Have you considered asking the PPC for set-aside by consent?0

That's the standard fee for a contested set-aside - if the PPC will agree (consent) to a set-aside then the lower fee would normally be payable. Check also whether you'd be eligible for assistance with court fees.Jenni x3

Can someone kindly confirm the below as I’ve got two different answers from the CCBC and a solicitor. If I apply for set aside and the decision came after the 18/3 /22 (the date I’ve got to settle the money) and the judgement against to my wishes, do I still get another 1 month to pay from the date of the judgement following the set aside? Or is it going to be in my records for 6 years as I have not paid before the original date they have given me?Also another question- I always wanted to challenge this parking company. But when I think back
- the signposting were accurate
- they have a paid dropping off point
-I’ve got 3 PCNs
is there chance for me to win the case?
thank you.0 -

what’s PPC? and how do I get the consent from them?0 -
I am really surprised that we are 22 pages in and you're asking what PPC means - have you read the NEWBIES thread yet in the 2.5 years since you started this thread? (There's a post which explains all commonly-used acronyms).
How do you think you get consent? You ask them. (But they'll probably want the judgment value paid as part of the consent - up to you whether you want to do this).Jenni x3 -

Hi all,
im so sorry to ask you questions after questions. I decided to go further because definitely you gave me a confidence. The situation now-
I travelled abroad on 23/1/22 and returned back to the country on 18/2/22
I got the claim form - issue date 27/1/22
i saw this when I came back from my holiday
The form is asking for a total amount of £726.08
obviously I could not respond on time as I was not in the country
therefore judgement made against me on 18/02/2022 of £726.08 and which also the same on the moneyclaim.gov.uk till now
I got another letter headed as ‘judgement for claimant (in default)’ saying I must pay the claimant a total of £750.28 forthwith.
I recently found out that I am 9 weeks pregnant. I had a traumatic miscarriage last year and strongly believe this was due to stress. Because I want to protect this baby and do not want to go through a hassle, I contacted the the DCB to settle the amount. They told me I have now pay £940.04 this was done on the 21/2/22. They told me the claimant have the right to do this in the 30 days from the judgement.I was so upset and now not sure if I should pay this amount. As mentioned in my previous posts, I have got some advise from free legal services including citizen advice b. I got different advices
- it’s fine to pay the amount and then set aside to protect your credit record
-once you paid that means you accepted that the claimant owe this money and therefore you cannot then request for set aside
- once you set aside and do not pay the amount before 18/03/22 and the judgement came after the date and not on your wishes- then your credit record will be affected from 18/03/22
I really appreciate your input!! Please give me an advice, what should I do now?Should I just give up and pay what ever they asks me!! I cannot accept the fact that the total amount has gone up to £940 over the weekend! Please please help.. I am a pain for everyone!0 -
I am NOT any sort of expert on CCJs but would certainly suggest that you look into this carefully. If you got a Court order saying judgement in default, and in the sum of £750.28 then I cannot imagine how it can go up like that
What reason did they give, do you have anything about that increase in writing? Are you planning to go for set aside? There are many threads on here that will help with thatThe pen is mightier than the sword ..... and I have many pens.3 -
Ask for that in writing from them - email them, stating they communicated this to you in a phone call (is that correct?). If judgment was dated 18/02/22, you normally get 1 month in which to pay, so there's a bit of time to play with - but it does depend on the details of the court Order. They told me I have now pay £940.04 this was done on the 21/2/22. They told me the claimant have the right to do this in the 30 days from the judgement. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
