Hi everyone,
Could really use some help please. I while back I parked in a local carpark near my house. I did not over stay the limit nor did I park on a yellow line. I parked in what I believed was a bay, however they said this was not a bay and that was the reason for the ticket.
I ignored all correspondance as advised a while back,
however I have now been given a county court business letter saying if I don't pay up I will be liable for a CCJ!
There is now a yellow line where I parked but this was not there when I parked there last year!
I understand I need to acknowledge this online. Do I put nothing in the defense box?
For my defense can I just tell them that I there was nothing to say the bay I parked in'was not a bay?
It's from UK car park management
Solicitors are Gladstones solicitors Ltd
Any help most appreciated!

First, there is no S in Defence
Do not put anything in the defence box, not even a full stop
Your defence is made up of legal arguments addressing the POC and landowner authority and poor signage etc, Not your "story"
What is the issue date from the top right of the claim form ?
Email a SAR to the DPO at the PPC to obtain all the documents and pictures and data about you and your vehicle asap0 -

Only if they do take you to court and win. From what you have told us they might struggle. Get your MP on board as nine times out of ten these tickets are scams.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -
I am replying via my mobile phone and with two young children in the background spelling was the least of my worries but thanks lol.
The date was on the 19th July on top of the letter
I'm not sure what the short hand terms mean. I will look them up. I really appreciate your responses! :money:
I will look into this information and respond in due course.0 -
Post two of the newb ies thread gives you all acronyms.
If you make mistakes here thats OK. Get it wrong in a court document and you have more issues.
You will be emailing a defence to the court, as a PDF, so you will need to get on a full computer soon enough.0 -
Stop using a mobile phone, it won't help
Get on a laptop asap and read post #2 of the newbies sticky thread near the top of the forum
I want you to start getting the spelling right for your legal court papers, because they are all about legal issues and expectations0 -
With a Claim Issue Date of 19th July, you have until Wednesday 7th August to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.
Having done the AoS, you have until 4pm on Wednesday 21st August 2019 to file your Defence.
That's nearly four weeks away. Loads of time to produce a perfect Defence, but please don't leave it to the last minute.
When you are happy with the content, your Defence should be filed via email as suggested here:-
Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
- Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
- Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.
0 - Sign it and date it.

Trying to find the acronyms can someone post a link?0
-
Acronyms found, thanks.
Once I have done the above I need to start putting together my defence.
After looking at these online they look very detailed. Does everyone write this themselves or is there a template I can follow. Im a bit nervous about all of this now.
Grateful for all help received.0 -
No template but thousands available on line to crib from. You have to make some effort when being taken to court I am afraid. You never know how far you can go until you go too far.0
