Defendant parked in a small car park with lots of bays.
The bay the defendant parked in was an end bay which was marked as a bay.
Claim states that the defendant did not park properly in a marked bay despite there being no clear markings to restrict parking (i.e. yellow lines) to say it WASN'T a bay.
A year later that bay now clearly has a double yellow restriction on the same bay previously parked in by defendant.0 -

Post 26 asked if you had checked for POFA compliance.
If you’re not sure at present it might be worth adding after the signage point:-
‘The Claimant is put to strict proof that their Notice to Keeper complies to the requirements of the Protection of Freedoms Act 2012’
This leaves the door open at WS stage to argue that they have failed - if that is the case.
Don’t leave it to the last minute to submit your defence.0 -
Take photos for your witness statement and check Google maps for prior images if available.0

Basically I parked in a small car park with lots of bays.
The bay I parked in was an end bay, they are charging me because they said it wasn't a bay but there were no markings (i.e. yellow lines) to say it WASN'T a bay. Now a year later that bay happens to have double yellow line marked on it so that shows you shouldn't park there.
I wasn't sure how to word this. . . Can you help?0 -
Thank you everyone for all your help. I have re read and edited my defence. I have printed signed and sent it out. I have had an auto response from the email so I know it's been sent off. Do I not do anything online with regards to the defence box? I guess I just wait now right?
